In Socialist Heritage, ethnographer and historian Emanuela Grama explores the socialist state’s attempt to create its own heritage, as well as the ongoing legacy of that project. While many argue that the socialist regimes of Central and Eastern Europe aimed to erase the pre-war history of the socialist cities, Grama shows that the communist state in Romania sought to exploit the past for its own benefit. The book traces the transformation of Bucharest’s Old Town district from the early twentieth century into the twenty-first. Under socialism, politicians and professionals used the district’s historic buildings—especially the ruins of a medieval palace—to emphasize the city’s Romanian past and erase its ethnically diverse history. Since the collapse of socialism, the cultural and economic value of the Old Town has become highly contested. Its poor residents decry their semi-decrepit homes, while entrepreneurs see it as a source of easy money. Such arguments point to recent negotiations about the meanings of class, political participation, and ethnic and economic belonging in today’s Romania. Grama’s rich historical and ethnographic research reveals the fundamentally dual nature of heritage: every search for an idealized past relies on strategies of differentiation that can lead to further marginalization and exclusion. Book excerpt: Linguistic and semantic features in names—and surnames in particular—reveal evidence of historical phenomena, such as migrations, occupational structure, and acculturation. In this book, Alexander Avram assembles and analyzes a corpus of more than 28,000 surnames, including phonetic and graphic variants, used by Jews in Romanian-speaking lands from the sixteenth century until 1944, the end of World War II in Romania. Mining published and unpublished sources, including Holocaust-period material in the Yad Vashem Archives and the Pages of Testimony collection, Avram makes the case that through a careful analysis of the surnames used by Jews in the Old Kingdom of Romania, we can better understand and corroborate different sociohistorical trends and even help resolve disputed historical and historiographical issues. Using onomastic methodology to substantiate and complement historical research, Avram examines the historical development of these surnames, their geographic patterns, and the ways in which they reflect Romanian Jews’ interactions with their surroundings. The resulting surnames dictionary brings to light a lesser-known chapter of Jewish onomastics. It documents and preserves local naming patterns and specific surnames, many of which disappeared in the Holocaust along with their bearers. Historical Implications of Jewish Surnames in the Old Kingdom of Romania is the third volume in a series that includes Pleasant Are Their Names: Jewish Names in the Sephardi Diaspora and The Names of Yemenite Jewry: A Social and Cultural History, both of which are available from Penn State University Press. In the aftermath of the Holocaust, returning survivors had to navigate a frequently unclear path to recover their property from governments and neighbors who had failed to protect them and who often had been complicit in their persecution. While the return of Nazi-looted art has garnered the most media attention, and there have been well-publicized settlements involving stolen Swiss bank deposits and unpaid insurance policies, there is a larger piece of Holocaust injustice that has not been adequately dealt with: stolen land and buildings, much of which today still remain unrestituted. This book is about the less publicized area of post-Holocaust restitution involving immovable (real) property confiscated from European Jews and others during World War II. In 2009, 47 countries convened in Prague to deal with the lingering problem of restitution of pre-war private, communal and heirless property stolen in the Holocaust. The outcome was the issuance by 47 states of the Terezin Declaration on Holocaust Era Assets and Related Issues, which aimed, among other things, to "rectify the consequences" of the wrongful property seizures. This book sets forth the legal history of Holocaust immovable property restitution in each of the Terezin Declaration signatory states. It also analyses how each of the 47 countries has fulfilled the standards of the Guidelines and Best Practices of the Terezin Declaration, issued in 2010 in conjunction with the establishment of the European Shoah Legacy Institute (ESLI) to monitor compliance. The book is based on the Holocaust (Shoah) Immovable Property Restitution Study commissioned by ESLI, written by the authors and issued in Brussels in 2017 before the European Parliament.

Moses was approached on the streets of Bucharest by young Jews seeking help to emigrate to Israel. This became the author's mission until the communist regime fell in 1989. Before that Moses had met periodically with Romania's communist dictator, Nicolae Ceausescu, to persuade him to allow increased Jewish emigration. This experience deepened Moses's interest in Romania—an interest that culminated in his serving as U.S. ambassador to the country from 1994 to 1997 during the Clinton administration. The ambassador's time of service in Romania came just a few years after the fall of the Berlin Wall and the subsequent collapse of communism in Eastern Europe. During this period Romania faced economic paralysis and was still buried in the rubble of communism. Over the next three years Moses helped nurture Romania's nascent democratic institutions, promoted privatization of Romania's economy, and shepherded Romania on the path toward full integration with Western institutions. Through frequent press conferences, speeches, and writings in the Romanian and Western press and in his meetings with Romanian officials at the highest level, he stated in plain language the steps Romania needed to take before it could be accepted in the West as a free and democratic country. Bucharest Diary: An American Ambassador's Journey is filled with firsthand stories, including colorful anecdotes, of the diplomacy, both public and private, that helped Romania recover from four decades of communist rule and, eventually, become a member of both NATO and the European Union. Romania still struggles today with the consequences of its history, but it has reached many of its post-communist goals, which Ambassador Moses championed at a crucial time. These disputes can concern a disparate variety of issues. A substantial number of have concerned the restitution of stolen and illegally exported art objects. Another set of controversies has involved the protection of immovable cultural heritage. Unlike other fields of international law, international cultural heritage law does not have an ad hoc mechanism of dispute settlement. As a result, controversies are to be settled through negotiation or, if this fails, through existing dispute resolution means, which include arbitration and litigation before domestic courts or international tribunals. This ad hoc fashion of dealing with disputes is not without consequences. The most serious problem is that the same or similar cases may be settled in different ways, thereby bringing about an incoherent and fragmentary enforcement of the law. This book offers a comprehensive and innovative analysis of the settlement of cultural heritage disputes. It addresses the means the potential fragmentation can be resolved by providing a two-fold analysis. First, it provides a detailed analysis of the existing legal framework and the available means of judicial and non-judicial dispute settlement. Second, it explores the feasibility of two solutions for overcoming the lack of a specialized forum. The first potential solution is the establishment of a new international court. The second concerns existing judicial and extra-judicial fora and means of increasing interaction between them by the practice of 'cross-fertilization'. The book focuses on the substance of such interaction, and identifies a number of culturally-sensitive parameters which need to apply (the 'common rules of adjudication'). Ultimately the book argues that existing judicial and non-judicial fora should adopt a cross-fertilizing perspective to use and disseminate jurisprudence containing these common rules of adjudication, to enhance the effectiveness and coherence of their decision-making processes. Finally, it sets out how such an approach would be conducive to the development of a wider body of international cultural heritage law.
