Book International Canals

Download or read book International Canals written by Edward Arthur Whittuck and published by . This book was released on 1920 with total page 144 pages. Available in PDF, EPUB and Kindle. Book excerpt: In preparation for the peace conference that was expected to follow World War I, in the spring of 1917 the British Foreign Office established a special section responsible for preparing background information for use by British delegates to the conference. International Canals is Number 150 in a series of more than 160 studies produced by the section, most of which were published after the conclusion of the 1919 Paris Peace Conference. Written by Edward Arthur Whittuck (1844-1924), a specialist in Roman and international law associated with the University of Oxford and the London School of Economics and Political Science, the study is one of relatively few in the series issued under the name of an individual author. The book is concerned with the Suez Canal and the Panama Canal, "interoceanic canals," which, by virtue of their commercial and strategic importance, had acquired a special status under international law. The section on the Suez Canal discusses the background to the building of the canal, the legal and practical aspects regarding its protection, and the negotiations to internationalize the canal. The latter led to the conclusion of the Convention of 1888, signed by nine European powers, which stipulated that "the Suez Maritime Canal shall always be free and open, in time of war as in time of peace, to every vessel of commerce or of war, without distinction of flag." The section devoted to the Panama Canal covers the history of antagonism between the United States and Great Britain over the construction and operation of an isthmian canal in the Western hemisphere. It focuses on the Clayton-Bulwer Treaty of 1850 and the Hay-Pauncefote Treaty of 1901, which superseded the earlier agreement. A concluding section discusses the roles played by both canals during World War I. The appendix includes the texts of the main treaties governing the international legal status of the canals.

Book excerpt: The relationship between straits and interoceanic canals has always been ambiguous. Unlike straits, interoceanic canals are neither natural nor subject to a universal legal regime like the Law of the Sea. However, straits and interoceanic canals share comparable historical experiences due to their geographic similarities. Suspending interest in a purely legal analysis, The Panama Canal lets logic yield to experience and considers the Panama Canal as an “artificial strait.” The volume recasts the dynamic events that have changed the Panama Canal in the context of three interactive elements: environments, flows, and territoriality. Cleverly deciphering from history how changes in one element led to changes in another, The Panama Canal suggests a considerably new perspective for viewing the canal’s past and future.

Available in PDF, EPUB and Kindle. Book excerpt: The study addresses from a governmental perspective the legality of the 1977 Panama Canal Treaty, and related political, economic, and national interest aspects resulting from the transfer of control of the Panama Canal from the United States to Panama under the Treaty. Under the Treaty, the United States turned over to Panama, entirely gratis, $3.4 billion in lands and properties, including strategic military bases. The study concludes that the Panama Canal Treaty is illegal and unenforceable. Under international law, the terms of a treaty must be mutually agreed to by all signatories, but the United States and Panama never agreed to the same Treaty language. The Treaty language as approved by the United States Senate was never agreed to by Panama, and the Treaty has never been signed by the President of Panama, as required by the Constitution of Panama. Also, the Canal was ?property? of the United States, but its transfer was not approved by the House of Representatives, as provided for by Article IV of the United States Constitution. Counterarguments to these conclusions are presented. The Canal is wrapped inextricably with the free world and global strategy, and the United States? ability to utilize the Canal for uninterrupted commerce is essential to its commercial and financial wellbeing. The Canal has been critical to the United States military and commerce in the past, and it will continue to be so. Narco-terrorists are a potential threat to Panama and the Canal. Entire cities within Colombia, which borders Panama, are controlled by drug cartels and Colombia is fighting for its very existence. The Narco-terrorists are infectious and expansionistic and their threat of taking control of the Canal is genuine, and their hostile intentions against democracy and governmental functions are unambiguous.
