Book excerpt: A key feature of those who work for the state, in the legal system and in public services is that they claim to be putting their own personal interests aside and working in a disinterested fashion, for the public good. But is disinterested behaviour possible? Can law be treated as a set of universal rules that are independent of particular interests, or is this mere ideology? Is the state bureaucracy a universal class, as Hegel thought, or a structure that serves the interests of the dominant class, as Marx claimed? In his lecture courses at the Collège de France in 1987–88 and 1988–89, Pierre Bourdieu addressed these questions by examining the formation of the legal and bureaucratic fields characteristic of the modern state, uncovering the historical and social conditions that enable a social group to form and find its own interests in the very fact of serving interests that go beyond it. For a disinterested universe to emerge, it needs both the invention of a public service, or a spirit of service to the public cause, and the creation of a social universe in which individuals can pursue a career devoted to public service and be rewarded for it. In other words, it requires a process of specialization whereby autonomous, specific fields become established in the social cosmos within which a special kind of game that follows the rules of disinterest can be played out. By reconstructing the conditions under which an interest in disinterestedness emerged, Bourdieu sheds new light on the formation of the modern state and legal system and provides a fresh perspective on the many professions in modern societies that are oriented towards the service of the common good.

In spite of this, Hilgers argues that one cannot reject it if one wishes to understand the nature of art. He claims that an artwork typically asks a person to adopt a disinterested attitude towards what it shows, and that the effect of such an adoption is that it makes the person temporarily lose the sense of herself, while enabling her to gain a sense of the other. Due to an artwork’s particular wealth, multiperspectivity, and dialecticity, the engagement with it cannot culminate in the construction of world-views, but must initiate a process of self-critical thinking, which is a precondition of real self-determination. Ultimately, then, the aesthetic experience of art consists of a dynamic process of losing the sense of oneself, while gaining a sense of the other, and of achieving selfhood. In his book, Hilgers spells out the nature of this process by means of rethinking Kant’s and Schopenhauer’s aesthetic theories in light of more recent developments in philosophy–specifically in hermeneutics, critical theory, and analytic philosophy–and within the arts themselves–specifically within film and performance art.

Critique of Judgment completes the Critical project begun in the Critique of Pure Reason and the Critique of Practical Reason (the first and second Critiques, respectively). The book is divided into two main sections: the Critique of Aesthetic Judgment and the Critique of Teleological Judgment, and also includes a large overview of the entirety of Kant's Critical system, arranged in its final form. The end result of Kant's Critical Project is that there are certain fundamental antinomies in human Reason, most particularly that there is a complete inability to favor on the one hand the argument that all behavior and thought is determined by external causes, and on the other that there is an actual "spontaneous" causal principle at work in human behavior. Immanuel Kant (1724-1804) was a German philosopher, who, according to the Stanford Encyclopedia of Philosophy is "the central figure of modern philosophy." Kant argued that fundamental concepts of the human mind structure human experience, that reason is the source of morality, that aesthetics arises from a faculty of disinterested judgment, that space and time are forms of our understanding, and that the world as it is "in-itself" is unknowable. Kant took himself to have effected a Copernican revolution in philosophy, akin to Copernicus' reversal of the age-old belief that the sun revolved around the earth.

Secondly, it attempts to explore what exactly makes artistic production a strong – yet neglected – field of political critique when democratic political agency, history from below and identity politics are threatened. Since aesthetic judgment of the beautiful becomes possible only when the mind is confronted with things of nature, for which no determined concepts of understanding are available, aesthetic judgment is involved in an epistemological or, rather, para-epistemological task. The predicate "beautiful" indicates that something has minimal form and is cognizable. This book explores this concept of form, in particular the role of presentation ("Darstellung") in what Kant refers to as "mere form," which involves not only the understanding, but also reason as the faculty of ideas. Such a notion of form reveals why the beautiful can be related to the morally good. On the basis of this reinterpreted concept of form, most major concepts and themes of the "Critique of Judgment"--such as disinterestedness, free play, the sublime, genius, and beautiful arts--are examined by the author and shown in a new light.
