Book excerpt: In Familiaris Consortio, Pope John Paul II emphasized that: "Since God's plan for marriage and the family touches men and women in the concreteness of their daily existence in specific social and cultural situations, the Church ought to apply herself to understanding the situations within which marriage and the family are lived today, in order to fulfill her task of serving." Reflecting on the above mentioned teaching, the researcher aims at the situation of Vietnam where marriages between the Catholics and the non-baptized are increasing day by day. These are called the disparity of cult marriages. Such marriages are treated in canon 1086 of the 1983 Code of Canon Law: a marriage is invalid when one of the two persons was baptized in the Catholic Church or received into it and the other was not baptized. Such a relationship is classified as an impediment which is not to be dispensed unless the conditions mentioned in can. 1125 and 1126 have been fulfilled. It is necessary for the local Church, concretely the pastors, to properly understand the teachings of the Church as well as the juridical aspects of the disparity of cult marriage. Therefore laws in question can be adequately applied in local Church, thereby the pastors can help both the faithful and the non-baptized entrusted to their care. With this necessity, special consideration is given in this thesis entitled: "A study on the disparity of cult as an impediment to marriage in the 1983 Code of Canon Law and its application in Vietnem." This thesis is divided into five chapters: Chapter One is the general introduction to the thesis which presents an over-view of the whole framework; Chapter Two expresses the basic understanding of the Catholic marriage and the matrimonial impediments in the context of the Church; Chapter Three gives the presentation of the impediment on the disparity of cult, in a canonical manner; Chapter Four mainly concentrates on applying the provisions of canon law to the marital impediment of disparity of cult in Vietnam's situation. The thesis ends with Chapter Five which includes a summary, some conclusions and recommendations based on the points stressed on this research.

This right is safeguard-ed by Canon Law for every Christ’s faithful. Anyone who is not prohibited by the law can contract marriage validly. This right, however, is not absolute because it can be restricted either by the divine law or ecclesiastical law for the higher end or the common good. Hence, marriage is not merely a private or personal act, but it is also a social institution. A good marriage and family not only contributes to the overall welfare of the individual and but also of the public good of the society, including the Church. Therefore, marriage in the Church, even if only one party is a Catholic, is governed not only by the divine law but also by ecclesi-astical law. One of the ecclesiastical laws which govern marriage is can. 1086 that contain the impediment of the disparity of cult. This canon invalidates marriage between a Catholic with a non-baptized. Hence, this canon is a restriction toward ius connubii of Christ’s faithful. Ad normam can. 11, the law is binding to all Catholics or those who have been received into the Catholic Church, have the use of reason and has completed seven years of age. Because can. 1086 is of merely ecclesiastical law, it can be dispensed by the local ordinary for a just reason. To grant dispensation, the local ordinary has to observe provi-sions of can. 1124-1125 (ad cautelam). When dispensation has been granted by the local Ordinary, a Catholic can contract a valid marriage with a non-baptized. Although it is a valid canonical marriage, but not a sacrament. In order to safeguard the faith of the Catholic party and to have the children born in such family be brought up in the Church, the pastor of the souls and the Christian community have the responsibility to make an adequate preparation before the marriage is contracted and to continue giving spiritual and communal supports for the life of a mar-riage with dispensation from the disparity of cult. For this purpose, a canonical and pasto-ral guideline is needed. This canonical and pastoral demand should be addressed by Ma-kassar Vicariate as a small part of the universal Church which is living in the midst of a heterogeneous society in South Sulawesi, Indonesia.
