Book excerpt: Abstract: This is a policy analysis of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003, commonly referred to as Medicare Part D by Medicare beneficiaries and the wider health care community. Before the enactment and implementation of the policy, prescription drug coverage was not a part of the more extensive Medicare benefits. There are two main objectives of the policy. The first is to offer prescription medication coverage to all eligible beneficiaries. The second is to provide access to needed prescription medications for beneficiaries. The following policy analysis analyzes the impact of the Medicare Part D policy on beneficiaries with chronic medical conditions who may need access to specialty medications and the effect on beneficiaries of color.

Book excerpt: The Medicare Prescription Drug, Improvement, and Modernization Act (MMA) of 2003 provided a voluntary prescription drug plan to strengthen its program and coverage for seniors and younger people with disabilities. The MMA's impact reduced pharmaceutical rebates and health system revenues while causing an increase in prescription out-of-pocket costs and hospital visits and admissions. For beneficiaries prescribed anti-cancer drugs, insurmountable out-of pocket costs led to financial toxicity and catapulted the use of Patient Assistance Programs to help mitigate drug expenses. This research study is a qualitative analysis of past data of Medicare Part D and the utilization of Patient Assistance Programs for specialty/cancer medications for the underinsured. The finding of this research showed that cancer patients experience financial toxicity more than any other group with chronic conditions due to the high costs of cancer drugs. The average spending of cancer patients for their comprehensive care in treating their disease is more than 20% of their annual income. For cancer centers, the providers' role is vital with price transparency of chemotherapy costs and being an influential advocate to legislators and pharmaceutical companies in lowering costs and improving drug access. As spending on prescription drugs continues to rise yearly, policy change looms ahead in the possibility of repealing the non-interference clause or implementing the new rule to help lower out-of-pocket costs. Although Patient Assistance Programs are a viable safety net for patients in increasing access to their medications, they should not deter policymakers from further improving the prescription drug plan.

Book excerpt: The Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (MMA, P.L. 108-173) made several major changes to Medicare including (1) adding a voluntary Medicare Part D outpatient prescription drug benefit effective January 1, 2006; (2) offering Medicare beneficiaries discounted prescription drugs in 2004 and 2005 through an endorsed discount card; (3) modifying various Medicare payment rates. The new Medicare drug benefit is funded in two ways: (1) by traditional Medicare funding through enrollee payments and the Health Insurance Trust Fund; and (2) by phased-down (commonly referred to as “clawbackâ€ŗ) payments from the states to the federal government. The state payments reflect the fact that starting in 2006, Medicare Part D will replace the prescription drug benefits currently received by dual eligibles (individuals enrolled in both Medicaid and Medicare) through state Medicaid programs. The funding mechanism for the new Medicare prescription drug benefit has the potential to reduce both Medicaid and other state health expenditures. However, two types of issues associated with the financing of Part D may affect the potential for state budget savings: (1) technical issues associated with the formula for calculating phased-down state payments to the federal government; and (2) policy issues raised by MMA that may directly or indirectly impact Medicaid and other state health programs. This report outlines the issues associated with the financing of Part D coverage through phased-down state payments to the federal government, as well as the potential impacts of the Medicare drug benefit on Medicaid and other state health expenditures. It will not be updated.
