It argues that this power can be assessed through studying the policy implications of there being a supranational constitution that was drafted as an international treaty. An international treaty contains a set of policy goals for future cooperation. Direct effect and supremacy give constitutional status to these policy goals, allowing the Court to develop the Treaty's implications for policymaking at the European and the member-state levels. By focusing on the four freedoms (of goods, services, persons, and capital) and citizenship rights, the book analyses the implications of case law for policymaking in different case studies. It shows how major EU legislation (for instance, the Services and Citizenship Directives) are significantly influenced by case law and how controversial policies, such as EU citizens' access to tax-financed social benefits, are closely linked to the Court.

The International Labour Organisation estimates that in 2013 there were 112 million resident migrant workers in the 58 highest-income countries, who made up 16% of the workforce. Non-resident workers have also increasingly become part of the labour available for employment in other states, often on a temporary basis. This work takes a thematic and comparative approach to examine the profound implications of contemporary labour migration for employment law regimes in highly developed countries. In so doing, it aims to promote greater recognition of labour migration-related questions, and of the interests of migrant workers, within employment law scholarship. The work comprises original analyses by leading scholars of migration and employment law at the European Union level, and in Australia, Canada, Germany, Italy, the Netherlands, Spain, the United Kingdom and the United States. The specific position of migrant workers is addressed, for example as regards equality of treatment, or the position in employment law of migrant workers without a right to work. The work also explores the effects of migration levels and patterns upon general employment law – including the law relating to collective bargaining, and remedies against exploitation.

Book excerpt: Britain's coalition government of 2010–2015 ushered in an enduring age of austerity and a "moral mission" of welfare reform as part of a drive for deficit reduction. Stricter controls were applied to both domestic welfare and international migration and asylum, which were presented as two sides of the same coin. Policy in both areas has engaged a moral message of earned entitlement and invites a sociological approach that examines such policies in combination, alongside their underpinning moral economy. Exploring the idea of a moral economy – from its original focus on popular rebellion at the rising price of corn to more contemporary analysis of measures that seek to impose moral values from above – Lydia Morris examines Britain's reconfigured pattern of rights in the fields of domestic welfare and migration. Those in power have claimed that heightened conditions and sanctions for the benefit-dependent domestic population, both in and out of work, will promote labour market change and reduce demand for low-skilled migrant workers, often EU citizens, whose own access to benefits was curtailed prior to Brexit. Morris traces related political discourse through to the design and implementation of concrete policy measures and maps the diminished access to rights that has emerged, paying particular attention to the boundaries drawn in defining target groups, and the resistance this has provoked. The Moral Economy of Welfare and Migration considers the topology of the whole system to highlight cross-cutting devices of control that have far-reaching implications for how we are governed as a total population.

Book excerpt: Over the last three decades, numerous radical right populist parties (RRPP) have emerged, developed, and strengthened their electoral weight in Western Europe. Yet, while several RRPP have managed to formally participate in government coalitions (such as in Italy, Austria, and Switzerland) or to informally support minority governments (such as in Denmark, and in The Netherlands) and while other RRPP have become highly visible opposition forces (such as in France, and Germany), the influence exercised by RRPP remain underexplored. It is essential to focus on their policy influence because of their electoral strength but also because they are often perceived by journalists, citizens, policy-makers as well as by researchers as a threat to democracy. As a reaction, mainstream parties tend to adopt specific strategies - such as measures of militant democracy towards RRPP. The aim of this book is to contribute to theoretical and empirical research in political science by bringing together a variety of contributions about the influence of RRPP in terms of policies on their core issues. To that end, we ask under which circumstances these parties are able to do so in contemporary Western Europe. This book proposes to focus on the role played by party status. Are RRPP better able to leave their imprints when they are in power or support minority governments than when they hold opposition or outsider status in Western Europe?

By interrogating the history, wording, omissions, assumptions and applications of laws, policies and discourses pertinent to mobility and equality, the argument developed throughout the book is that the parameters of CEE nationals’ status within the EU have been closely circumscribed, in line with the entrenched historical positioning of the west as superior to the east. Engaging current legal, economic, political and moral issues--against the backdrop of Brexit and contestations over EU integration and globalisation--this work opens avenues of thought to better understand law’s role in producing and sustaining social stratifications. Europe is a postcolonial space, as this book demonstrates.
