Book excerpt: Conflict between the Roman Catholic Church and the State in Mexico became prominent soon after independence in 1821, and during the next three decades national and state governments made various attempts to reduce ecclesiastical influence in the social, economic and political life of the nation. Few of such efforts met with much success, and it was not until 1856 that a major reform was initiated. Legislation was issued which affected all spheres of clerical activity but the most vital and controversial aspect of the reform involved the measures adopted to dispossess the Church of its wealth. The extensive ecclesiastical holdings of urban and rural real estate and capital were nationalized and redistributed. Professor Bazant examines earlier attempts at nationalization, and describes in detail the implementations of the 1856 Lerdo Law and subsequent decrees. Using selected areas of the country, he traces the precise effects of the redistribution of Church property and capital, describing the terms of sale or transfer, the number of sales, the buyers, their nationality and occupation, and the total value of the amounts involved.

In an introductory historical survey, the author considers the earlier provisions for civil law appeal, the circumstances surrounding the creation of the Court of Delegates, and its history from the mid-sixteenth century until 1832. After a general discussion of the jurisdiction of the court, Dr Duncan goes on to a detailed discussion of several jurisdictional problems: in particular he deals with the relationship between the Court of Delegates and certain other Judicial bodies, and with the extent of the Court's original jurisdiction. He devotes two chapters to commissions of delegacy and commissions of review, analysing the rules which governed the right of a party to appeal to the Court of Delegates, and also to appeal from a decision of that Court. Head confronts the central paradox of Norfolk's career - one that lies in his unpleasant personality, marked by vain and tyrannical behavior. Ultimately these flaws prohibited him from achieving the social position he believed was owed to him, mainly because of his family's status and wealth. Essentially a conservative, socially and religiously, Norfolk was uncomfortable with reformation ideology and the "low-brow" men of the court. The duke sought a primary position within the court on the model of that earned by Cromwell and Wolsey but was unwilling to perform the sustained hard work required to achieve that stature. By the 1540s Norfolk was probably the richest man in England, but nonetheless, at the hands of Cromwell and Wolsey, he was repeatedly exiled from the court for emotional excesses. He found himself assigned to posts at considerable distances from the crown - military assignments in France and diplomatic appointments to Ireland and Scotland. While in France he illustrated the cruelty of his character by hanging dozens of men and lamenting his lack of authority to execute more.
