The first of these may be called the period Of experiment. It extends from the earliest beginnings down to the year 1700. During this time the prac tice Of keeping mortality records originated, and the funda mental laws Of probability were evolved and applied to the valuation of human life. Underwriting was done by indivi duals, and toward the end Of the period some distribution Of risk was accomplished by the insurers, since it became custom ary to accept but a small portion of each one of a number of separate hazards. The second stage may be designated the speculative assessment period.' It extends from 1700 to 1721, and is distinguished by the fact that assessment associations Of a highly speculative nature were formed for effecting life insurance. The third period, from 1721 to 1760, may be termed the era of scientific progress, since it is characterized by the progress made in the science of life contingencies. The fourth and last epoch, from 1760 to 1800, is One in which the advent of modern life insurance occurred. It was during this time that insurance for the whole of life on an annual level premium basis, and with a reserve fund to meet liabilities in creasing with advancing age, was put into practical operation. Book excerpt: Excerpt from Accidental Means: A Brief on the Insuring Clause of Personal Accident Policies The author, in common with other insurance lawyers, has long realized that there is no work on accident insurance which deals exhaustively with the questions arising in connection with the determination of the precise liability of accident com panies under the insuring clause of their policies. Practicallyall of the reported decisions in the United States bearing upon these questions have been discussed and classified in this brief. The attached table of cases, arranged alphabetically, indicates the page or pages of the brief on which each case has been cited or discussed. If it is desired to determine the particular holding of any case, in so far as the construction of the insuring clause is concerned, it is only necessary to refer to the table of cases. Death is brought about in an infinite number of ways. The insuring clause of an accident policy attempts in a few lines to limit liability to a fraction of that infinite number. It is, therefore, absolutely indispensable that this insuring clause be drawn without ambiguity. It is further essential, in de ciding the multitude of border line cases, to first determine definitely the real meaning of the insuring clause and the gen eral principles by which its interpretation must be governed, and then to reason very closely in order to correctly apply these principles. In the seventeenth century the idea of insuring individuals against accidents seems to have been first contemplated in France. But not until the middle of the nineteenth century was the first English company formed for this purpose. The first American company was not organized until about 1860. In England the policies were framed for the purpose of paying definite indemnities for specific injuries, such as the loss of a limb, blindness, etc., The earliest American policies were based on their English prototypes. They were not adapted to the newer country, with its different customs and habits of life, its varied occupations and risks, and the companies which had embarked in the business met with disaster and failure. Shortly the pioneers in the industry undertook the scientific construction of a system of accident insurance, evolving new tables of rates, new classifications of risks, and new methods of business, based upon conditions in the United States. In a short time it was demonstrated that by a statistical and mathematical calculation a table of risks could be prepared on the same principle employed in the construction of mortality tables by life insurance companies, upon which could be based a reliable and equitable system of accident insurance. In the United States accident insurance was inaugurated with the sale of so-called "accident tickets" to travelers on railroads covering only risks of travel, and in most instances good only for periods of twenty-four hours or the duration of specific trips. These tickets were sold at railroad stations. It soon became manifest that only a small percentage, not above ten per cent., of accidents resulted from traveling.
