As he examines what the Constitution has meant to the American people (perceptions and misperceptions, uses and abuses, knowledge and ignorance), Kammen shows that although there are recurrent declarations of reverence most of us neither know nor fully understand our Constitution. How did this gap between ideal and reality come about? To explain it, Kammen examines the complex and contradictory feelings about the Constitution that emerged during its preparation and that have been with us ever since. He begins with our confusion as to the kind of Union we created, especially with regard to how much sovereignty the states actually surrendered to the central government. This confusion is the source of the constitutional crisis that led to the Civil War and its aftermath. Kammen also describes and analyzes changing perceptions of the differences and similarities between the British and American constitutions; turn-of-the-century debates about states' rights versus national authority; and disagreements about how easy or difficult it ought to be to amend the Constitution. Now in paperback, The Common Law Tradition is a collective portrait of five scholars who epitomize the tradition.The focus is Chicago in the 1960s. The five figures considered--Edward H. Levi, Harry Kalven, Jr., Karl Llewellyn, Philip Kurland, and Kenneth Culp Davis--did much to broaden the perspectives of the legal academy. Levi made use of sociology, economics, and comparative law. Kalven collaborated with sociologists on the Jury Project and with economists on tax law and auto compensation plans. Llewellyn's commitment to empirical research underpinned his work on the Uniform Commercial Code. Kurland's approach to constitutional law was highlighted by his insistence on the relevance of legal history. Davis was an energetic comparativist in his work on administrative law. What distinguished these Chicagoans is that their work was practical and rooted in the law, and hence yielded concrete applications. The group's diversity, the tolerant atmosphere in which they taught and wrote, and the attachment of its individual members to empirical approaches differentiate them from today's legal scholars and make their ideas of continuing importance.

Representative government, common law, and key trial rights such as habeas corpus grew out of these landmark documents. Magna Carta Magna Carta is the name later given to a document signed by king John of England under pressure from the barons and other notables of England in the summer of 1215 at a meadow called Runnymede, which is on the river Thames between London and Windsor. This remarkable document resulted from an aristocratic rebellion against the crown, sparked by king John's abusive use of his customary rights as lord of England. Though the rebellion began with the barons - who benefited most from John's concessions - success was ensured by John's alienation of the church and the rising merchant class, symbolized by the City of London. But remarkable as the original agreement was, it acquired its elevated position in the legal and constitutional history of England as much from what men thought it said as from what its provisions actually contained. Magna Carta was actually issued several times during the 12th century, often with substantial revisions. Entangled in dynastic wars at home and in France, and carrying on Crusades in the Holy Land, English kings required tremendous amounts of money to finance their armies and pay for the increasingly centralized government. Unsurprisingly, sentiments of rebellion grew stronger and stronger among the landed barons and wealthy merchants as royal demands for their money grew heavier and heavier. Thematically oriented chapters help readers differentiate fact from fiction regarding this pivotal charter in the history of human freedom. Furthermore, the pivotal roles played by the Church, of the landed barons, and of the emerging merchants in England's towns in extracting the concessions from the crown are discussed in broad, yet detailed, strokes. Chapters on Magna Carta's profound influence on common law and the development of representative government follow. Fifteen biographies of key figures like Henry II, Pope Innocent III, William the Conqueror and Eleanor of Aquitaine enhance the narrative chapters, as do the extensive extracts of the Coronation Oath of Henry I, Magna Cartas of 1215 and 1225, the Charter of the Forest of 1225, and the final Confirmation of the Charters from 1297. Sunderland presents a strong, thoughtful challenge to the constitutional theories promoted by Ronald Dworkin, Archibald Cox, Richard Epstein, Michael Perry, John Hart Ely, Robert Bork, Philip Kurland, Laurence Tribe, Mark Tushnet, and Catharine MacKinnon—an enormously diverse group united by an apparent belief in judicial supremacy. Their theories, he demonstrates, undermine the democratic foundations of the Constitution and the power of the majority to resolve for itself important questions of justice. Central to this enterprise is Sunderland's reconsideration of The Federalist as the first, most reliable, and most profound commentary on the Constitution. "The Federalist," he states, "is crucial because it explains the underlying theory of the Constitution as a whole, a theory that gives meaning to its particular provisions." In addition, Sunderland reexamines the Declaration of Independence and the work of Hobbes, Locke, and Montesquieu, in order to better define the nature and limits of their influence on the Framers. His reading of these works in conjunction with The Federalist shows just how far afield contemporary commentators have strayed. Sunderland deliberately echoes and amplifies Madison's wisdom in Federalist No. 10 that the object of the Constitution is "to secure the public good and private rights . . . and at the same time to preserve the spirit and form of popular government." To attain that object, he persuasively argues, requires that the judiciary acknowledge and enforce the constitutional limitations upon its own powers. In an era loudly proclaiming the return of popular government, majority rule, and the "will of the people," that argument is especially relevant and appealing.
