Book excerpt: In this report the Public Administration Select Committee makes constructive suggestions for improving the Government's proposals for put forward in the March 2008 white paper on constitutional renewal and the accompanying draft bill. At present many important ministerial powers - the 'prerogative powers' may be excercised without parliamentary approval. The Committee's aim here is to open up the secret powers of the Executive to parliamentary scrutiny and approval. The proposals for the Civil Service were welcomed and it is felt that the purpose of legislation would be to protect the core values of integrity, honesty, objectivity, impartiality - and its key characteristics - recruitment on merit and the ability to serve governments from across the political spectrum. Suggestions to strengthen the draft further in this respect were made. The Government's proposals on the other prerogative powers were felt to be disappointingly limited and felt to contain loopholes which would allow the Exectuive to bypass Parliament at their discretion. The Committee found that the Government's draft resolution on war-making powers leaves too much discretion in the hands of the Prime Minister and describe the need to seek retrospective approval for urgent military operations as the price of democracy. The Committee also found, in relation to the making of treaties, that the Government's proposed Parliamentary safeguard could be ignored at will. They also urge swift progress on legislation on the procedures for issueing passports and a wider review of the prerogative powers.

Book excerpt: This report draws on and consolidates the Committee's work over the past decade in order to identify enduring principles of good government. It also applies these principles to set out proposals for reforming British government. The report concludes that many aspects of Britain's governing structures and principles work well, despite opinions to the contrary that are sometimes expressed. PASC also finds, however, that there are significant features of Britain's political system that inhibit good government. In particular, PASC concludes there are too many ministers and a political culture too focused on responding to media demands. This has resulted in an excessive number of initiatives being launched and laws being introduced, which in turn reduces government's ability to decide and follow a clear and consistent direction. PASC urges government to place less emphasis on responding to short-term political pressures and instead urges a stronger focus on ensuring good basic administration in government. PASC's conclusions about government in Britain are based on five requirements that it has identified as prerequisites for good government: (1) Good people: the need to recruit and cultivate people with the right skills and abilities to undertake the work of government effectively; (2) Good process: appropriate structures, systems and procedures in place to develop and implement policies successfully; (3) Good accountability: adequate arrangements for holding both elected and appointed officials to account for their decisions and actions; (4) Good performance: effective performance assessment to identify how well government is meeting its objectives and where it could improve; (5) Good standards: high ethical standards exhibited by people in public life, underpinned by robust ethical regulation and strong ethical leadership.

The current charging scheme for handling FOI requests is £600 for central government and £450 for other public authorities, based on a set rate of £25 per hour for officials' time. Where the estimated cost is below the limit, the information is provided free of charge, but when the limit is exceeded, the public authority can either provide the information for a charge or refuse to provide the information on grounds of lack of cost-effectiveness. The likely increase in the UN Regular Budget and other international subscriptions will push this figure even higher. The FCO should have to shoulder the financial burden from within its already tight budget to pay for subscriptions which also benefit other Government departments. The Committee recommends that additional nondiscretionary costs should properly be met by the Treasury.

Book excerpt: This is the 11th report from the Public Administration Select Committee (HCP 112-I, session 2007-08, ISBN 9780215521545) and focuses on public services and the third sector. Third sector organisations include charities and not-for-profit organisations as well as social enterprises. Government has been commissioning more public service deliveries from such organisations and the Committee, in this report, seeks to assess the impact of that policy approach, looking at the effects both on government and the service users as well as the public at large. The main claim for the use of third sector delivery service is that they can deliver a distinctive service that will improve the outcomes for service users. The Committee could not find evidence to corroborate that claim and believes that the Government's priority ought to be a greater understanding of the needs of the users of particular services and then identifying the organisation best placed to fulfil such services. The Committee believes such appointments should be based on merit as established through the tendering process but that importance lies with the commissioning authorities designing service specifications which play to the strengths of the best placed organisations. The Committee further states that "intelligent commissioning" is key, and that judgements about the use of a contract or grants, the importance of price on who wins the contract and whether there is scope for innovative methods of service delivery are important in getting the best result. The Committee also identified risks, and that it is important users of such services should not be affected whether a service is provided directly by the State or contracted out and that the Human Rights Act (PGA 1998. Chp. 42, ISBN 9780105442981) and the Freedom of Information Act (PGA 2000 Chp. 36, ISBN 9780105436003) should be extended to cover all organisations providing public service. Book excerpt: This report contains the Committee's views on the Ombudsman's report on the prudential regulation of Equitable Life throughout the 1990's until it was forced to close to new business in December 2000. Noting aswell that, now eight years later, the situation remains unresolved. The Committee feels that the Government should, without further delay, accept the Ombudsman's findings of maladministration on the part of the former Department of Trade and Industry, the Government Actuary's Department, and the Financial Services Authority. They support the Ombusman's recommendation for a full and unreserved apology from those public bodies concerned. There are valid arguments to be had about the means of providing redress, but there is concern that the Government may choose to act as judge on its own behalf by refusing to accept that maladministration took place. This would seroiusly undermine the Ombudsman;s office and the ability to learn lessons from the Equiable Life affair. The Committee also strongly supports the recommendation for a compensation scheme. Where regulators have been shown to fail so thoroughly, compensation should be a duty, not a matter of choice. While the aim should be restore individuals to the position they would have been had the maladministration not occurred, it is essential that the public purse benefits from an appropriate measure of protection. In particular, the emphasis must be on compensating individuals only for that loss that is fairly attributable to regulatory failure. Further, despite the basic presumption that loss must be accurately assessed, the main priority must be prompt resress. Policyholders have already been waiting almost a decade and substantial numbers have either died or are advancing in years. Justice delayed will mean justice denied to even more people.
