The book looks both at the British context as well as experience in other developed economies and takes stock of how the policy has evolved. It questions whether the local authority can be seen as a single entity in terms of housing or whether it is fragmented into separate departments. Incorporating in-depth empirical research from England and Wales, the book discusses whether the process of developing housing policy and allocating land needs to be more integrated, and whether key players such as speculative house-builders should be involved in the development of policy. Book excerpt: The contributors in this volume address the fundamental relationship between the state and its citizens, and among the people themselves. Discussion centers on a recent decision by the United States Supreme Court in the case of Kelo v. City of New London. This case involved the use of eminent domain power to acquire private property for purposes of transferring it by the State to another private party that would make "better" economic use of the land. This type of state action has been identified as an "economic development taking". In the Kelo case, the Court held that the action was legal within provisions of the US Constitution but the opinion was contentious among some of the Justices and has been met with significant negative outcry from the public. The Kelo case and the public debate arising in its aftermath give cause to assess the legal landscape related to the ability of government to fairly balance the tension between private property and the public interest. The tension and the need to successfully strike a balance are not unique to any one country or any one political system. From the United States to the United Kingdom, to the People's Republic of China, property and its legal regulation are of prime importance to matters of economic development and civic institution building. The Kelo decision, therefore, explores a rich set of legal principles with broad applicability.

Book excerpt: In order to tackle the problem of the shortage of affordable housing, the Office of the Deputy Prime Minister (ODPM) has been set a Public Service Agreement (PSA) target to achieve a better balance between housing availability and demand in all English regions whilst ensuring sustainable development which recognises environmental concerns. This joint study by the Audit Commission and National Audit Office focuses on one strand of the PSA target, relating to improving the availability of affordable housing in high demand areas. The report also identifies ten areas where efficiencies are likely to be achieved in the social housing funding system, and it makes a number of recommendations for national, regional and local bodies to improve both efficiency and effectiveness of the delivery chain, highlighting the need to increase the speed of delivery and to reduce the unit cost of housing.

For decades, successive Governments have failed to deliver sufficient homes to meet demand. The country faces a significant housing shortfall, and the financial crisis has amplified the problem. 232,000 new households are forming each year in England, and yet in 2011 fewer than 110,000 new homes were completed. The Committee sets out four key areas for action, which, taken together, could go a long way to raising the finance needed to meet the housing shortfall: large-scale investment from institutions and pension funds; changes to the financing of housing associations, including a new role for the historic grant on their balance sheets; greater financial freedoms for local authorities; new and innovative models, including a massive expansion of self build housing.

It sets out recommendations to reform the planning system in England in support of sustainable economic growth and prosperity, whilst securing delivery of wider objectives including promoting community involvement, supporting local democracy and enhancing the environment. Key issues identified include the need: to ensure the planning system is more responsive to the market whilst delivering sustainable development; to ensure the appropriate use of land and to better manage the growing demand for development land; to streamline the planning system to increase certainty, reduce complexity and costs; to enhance the speed and quality of local authority decision-making; and to improve the appeals system to reduce delays. Recommendations include: the introduction of a new system for dealing with major infrastructure projects, based around national Statements of Strategic Objectives, and with a new independent Planning Commission to determine applications; the promotion of a positive planning culture within the plan-led system so that applications should be approved unless there is good reason to believe that the environmental, social or economic costs will exceed respective benefits; encouraging planning bodies to review their green belt boundaries to promote sustainable new development beyond towns and cities; and removal of the need for minor commercial developments that have little wider impact to require planning permission.
