Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2001: In this compelling work, Matthew Flinders examines how far alternative forms of accountability have evolved and the extent to which they remedy the current shortcomings of the parliamentary system. Adopting a pluralistic perspective, this exploration of the accountability of the core executive is clearly grounded in research methodology, thus ensuring the book makes a valid, incisive contribution to the literature. Features include: - A detailed study of the location of power and mechanisms of accountability in modern government which challenges the largely prosaic existing literature - Useful summaries of the key tensions and trends within constitutional infrastructure - A new and refreshing approach to the study of central government - Insightful critiques of major governmental policies This intriguing volume will be of interest to undergraduates, post-graduates and lecturers for courses on legislative studies, central government reform, public administration, British politics and research methods.

Download or read book The Schematic State written by Debra Thompson and published by Cambridge University Press. This book was released on 2016-10-20 with total page 329 pages. Available in PDF, EPUB and Kindle. Book excerpt: By examining the political development of racial classifications on the national censuses of the United States, Canada, and Great Britain, The Schematic State maps the changing nature of the census from an instrument historically used to manage and control racial populations to its contemporary purpose as an important source of statistical information, employed to monitor and rectify racial discrimination. Through a careful comparative analysis of nearly two hundred years of census taking, it demonstrates that changes in racial schemas are driven by the interactions among shifting transnational ideas about race, the ways they are tempered and translated by nationally distinct racial projects, and the configuration of political institutions involved in the design and execution of census policy. This book argues that states seek to make their populations racially legible, turning the fluid and politically contested substance of race into stable, identifiable categories to be used as the basis of law and policy.

Download or read book Terrorism Detention Powers written by Great Britain: Parliament: House of Commons: Home Affairs Committee and published by The Stationery Office. This book was released on 2006-07-03 with total page 76 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report considers the police case for an increase in detention powers in respect of terrorism suspects, in particular their support of 90 days pre-charge detention. It looks at the background, both existing provisions, changes in the Terrorism Act 2006 and the origins of the police case; the terrorist threat, whether its nature has changed and alternatives to longer detention; and judicial oversight and detention periods. Although the Committee can find no evidence to suggest that 90 days pre-charge detention is essential they think that 28 days might prove to be inadequate. Because of this they recommend the creation of a committee, independent of Government, which will review the pre-charge detention period each year and make recommendations when necessary.
Download or read book Parliamentary Accountability written by Philip Giddings and published by Springer. This book was released on 2016-07-27 with total page 261 pages. Available in PDF, EPUB and Kindle. Book excerpt: Written by members of the Study of Parliament Group, this book assesses Parliament's response to the reorganisation of much of the civil service into 'executive agencies'. Chief executives have been given freedom to take operational decisions. Yet Ministers insist that they themselves remain constitutionally responsible for the work of the agencies. After reviewing Parliament's mechanisms and considering several case-studies, the authors conclude that Parliament has yet to exploit fully the opportunities for greater accountability which the new arrangements provide.

The third edition has been fully expanded and updated to include further coverage of a range of critical topics, including child sexual exploitation, child pornography, female sex offenders, treatment approaches such as the ‘Good Lives Model’ and the European Convention on Human Rights. Delving into and beyond the news headlines about sexual crimes that seem to appear on our screens and in our newspapers almost every day, this third edition draws on a range of high profile case studies, such as Vanessa George, Stuart Hall, Jimmy Savile and Operation Yewtree and also offers a review of all relevant legislation. This new edition also includes an analysis of possible causes of sex offending, as well as public and professional responses to sex crime. Including an examination of the policing of sexual crime; the prosecution of the accused; the sentencing and punishment of sexual offenders; and ‘public protection’ measures, this new edition covers all of the key aspects of sex crime and how it is dealt with. Wide-ranging and authoritative, Sex Crime, Third edition presents a complex area in a straightforward and understandable manner. Thomas guides the reader through the range of policies and law which have accumulated over the years, making this essential reading for academics and students engaged in the study of sex crime, sexual violence and the treatment of sex offenders. It will also be of great interest to criminal justice practitioners.

Download or read book Administrative Justice and Asylum Appeals written by Robert Thomas and published by Bloomsbury Publishing. This book was released on 2011-01-18 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: FIRST PRIZE WINNER OF THE SLS BIRKS PRIZE FOR OUTSTANDING LEGAL SCHOLARSHIP 2011 How are we to assess and evaluate the quality of the tribunal systems that do the day-to-day work of adjudicating upon the disputes individuals have with government? This book examines how the idea of adjudicative quality works in practice by presenting a detailed case-study of the tribunal system responsible for determining appeals lodged by foreign nationals who claim that they will be at risk of persecution or ill-treatment on return to their country of origin. Over recent years, the asylum appeal process has become a major area of judicial decision-making and the most frequently restructured tribunal system. Asylum adjudication is also one of the most difficult areas of decision-making in the modern legal system. Integrating empirical research with legal analysis, this book provides an in-depth study of the development and operation of this tribunal system and of asylum decision-making. The book examines how this particular appeal process seeks to mediate the tension between the competing values under which it operates. There are chapters examining the organisation of the tribunal system, its procedures, the nature of fact-finding in asylum cases and the operation of onward rights of challenge. An examination as to how the tensions inherent in the idea of administrative justice are manifested in the context of a tribunal system responsible for making potentially life or death decisions, this book fills a gap in the literature and will be of value to those interested in administrative law and asylum adjudication.
Download or read book Terrorism and the Law written by Clive Walker and published by Oxford University Press. This book was released on 2011-03-03 with total page 629 pages. Available in PDF, EPUB and Kindle. Book excerpt: Terrorism law and legal practice has been politically and socially controversial to a degree beyond almost any other legal issue during the past few years, and this analytical text contains extensive analysis of these controversies. Terrorism and the Law offers a thoughtful and up-to-date discussion of all the key materials on terrorism law. It provides comprehensive coverage of all the major domestic, European, and international laws, and their impact on the UK. It also contains an extensive examination of the implementation of these terrorism laws, and of the practical issues they raise. The book contains three Parts. Part I focuses on meanings of 'terrorism' in law and political science. It provides the reader with an understanding of the phenomenon and the legal concept, including its statutory definitions, which is essential to the book's assessment of the strategies and tactics adopted in the codes of laws. It also covers normative constraints, such as human rights. Part II focuses on the United Kingdom law. It provides extensive coverage of the major UK terrorism legislation, such as: the Terrorism Act 2000; the Anti-Terrorism, Crime and Security Act 2001; the Prevention of Terrorism Act 2005; the Terrorism Act 2006; the Terrorism (Northern Ireland) Act 2006; the Justice and Security (Northern Ireland) Act 2007; and the Counter-Terrorism Act 2008. It also examines the key laws and rules relating to terrorism policing and legal processes. It discusses the meaning of these legislative materials, as well as their implementation, and includes reference to case law and practice statements from the police and courts. Part III reflects the impact of European, international and transnational laws and practices, covering international transnational cooperation and extradition, key European Union law measures against terrorism, other international law measures against terrorist activities, and international human rights and terrorism.
