Book excerpt: Jones (emer., Welsh history, Cardiff Univ., Wales) offers a volume in two approximately equal parts: a translation of an updated text written in 1594 by George Owen of Henllys, North Pembrokeshire, and an introduction analyzing the text. Owen's subject is the administration of the legal institutions of Wales established by the Acts of Union issued by Henry VIII. The presentation is in the form of a dialogue between the Welshman Demetus (representing Owen's views) and Bartolus, a German traveling around Europe to observe the working of the governmental and legal systems found in various countries. Owen's point of view is that of the gentry who benefitted from Henry VIII's "reforms," as contrasted with the harsh regime earlier established by Henry IV. The dialogue gives a detailed picture of Pembrokeshire but only the sketchiest view of the other parts of Wales, and reflects the social and economic ambitions of the upper class of Welshmen with little regard to the urban dwellers or the more humble rural populace. Nonetheless, the dialogue reveals an interesting attempt to combine the legal court institutions of England with legal customs of Wales. Summing Up: Recommended. It began with a demand by MPs from all parties that a secretary of state be appointed, and ended in 1979 with the referendum on a Welsh assembly, the 'end of a era' in the words of Lord Cledwyn. This book shows how devolution was an issue in Welsh politics during the period under review, how British governments responded to devolutionists' demands, and how much was eventually conceded. Early on, two important developments were the setting up in 1949 of the Council for Wales and Monmouthshire and the appointment in 1951 of a minister for Welsh Affairs. Significantly the Council recommended in 1957 that a secretary of state be appointed and Labour acted on that proposal in 1964. The book examines the changing pattern of Labour thinking with regard to Wales and also the various nationalist challenges that threatened its dominance in the 1960s and 1970s. The referendum on the Labour government's devolution proposals is seen as bringing to an end a period in which both Labour and Conservative governments had been forced into a consideration of Welsh matters, and had been made to think about the precise way in which Wales should be administered within the British system.

This Bill proposes to extend devolved law-making powers, after further consultation, and a referendum. The Welsh Assembly Government would be established as an entity, separate from, but accountable to, the National Assembly for Wales. There would be be a new Welsh Consolidated Fund into which the Secretary of State would make payments out of moneys voted by Parliament, and the Assembly Government would be accountable to the Assembly for the use of budgetary resources. In the event of a vote in favour of "primary legislative powers" within devolved fields of competence without further recourse to Parliament [Westminster], procedures to regulate the relationship between Westminster and the Assembly would need to be developed, somewhat akin to those between Westminster and the Holyrood Parliament in Scotland. The Assembly would have more legislative freedom, for instance, powers to make subordinate legislation [Statutory Instruments]. The Bill also includes provisions concerning the conduct of Welsh Assembly general elections, the role and responsibilities of Assembly members. The first part comprises a detailed introduction to the background of "The Dialogue", written in 1594 by George Owen of Henllys, north Pembrokeshire, followed by an updated version of the text with explanatory notes. George Owen was the most observant Welsh historians of the late sixteenth century, and in the "Dialogue" he discusses the main functions of legal institutions of government in Tudor Wales following the Acts of Union (1536-43). The discourse is not merely a description of those institutions but rather, in the form of a dialogue, it provides an analysis of the good and bad aspects of the Tudor legal structure. Emphasis is placed on the administration of the Acts of Union, and comparisons are drawn with the harsh penal legislation which had previously been imposed by Henry IV. Owen reveals the strengths and weaknesses of the Henrician settlement, but heartily praises the Tudor regime, regarding Henry VII and Henry VIII as liberators of the Welsh nation which the author, in the 'prophetic tradition', associated with the nation's historic destiny. In this 'Dialogue' Demetus is described as a native Welsh gentleman and Barthol as the German lawyer from Frankfort travelling through Europe and observing legal practices. The Socratic method applied reveals the Renaissance style of conducting debates, a framework which gives the work much of its appeal. The "Dialogue" is an invaluable Tudor source which places Welsh Tudor government and administration in a broader historical perspective.
