Discusses prudent investor rule and suggests that if a trust is large enough, many advisors recommend to the trustee that a portion of the assets include alternative investments. These investments are generally structured as limited partnerships or limited liability companies. Discusses lack of clarity to the proper treatment of a partnership investment held by a fiduciary. Generally, current principal and income acts are inadequate in defining what is income or principal from a partnership interest, and trust instruments frequently fail to address this matter. This creates issues in determining FAI and DNI within the trust. There are inherent conflicts between Subchapter J and K. Looks at how separately stated items such as charitable contributions and portfolio expenses subject to the 2 percent floor are handled. Issues trust face in applying the passive loss rules particularly with real estate investments. Concludes that as trusts trend more and more to the modern portfolio theory of investing under the prudent investor rule, the trustee will be faced with numerous alternative investments. The structure of these investments, generally partnerships, tends to create numerous issues under Subchapter J. Therefore, it is imperative that the trustee understand the good, the bad and the ugly of investing in partnerships.

By educating himself first through BS, MS, PhD, plus wife with BA, then ex-wife through law school, followed by 3-children from ASU, NAU and U of A, 21-year span of college tuition, probably a record! How his life changed from this long maturing and educational period, throughout following activities in public, private and international careers, provides an interesting perspective on broader societal differences experienced in many countries, including the USA. Middle East, North Africa societies are far different than South Equatorial Africa, Asia and/or Europe and the Americas. The author's perspective greatly aided by having wives at different stages of his careers, first American, 2nd Persia (Iran), 3rd Philippines. Reaching apex of careers at age 78 was an exceptional feat then upon retirement until now the author's reflection on life's experiences and potential societal change are unique indeed!

The project was designed to answer questions of program operation and effectiveness, including the quality of the research projects being conducted under the SBIR program, the commercialization of the research, and the program's contribution to accomplishing agency missions. This report summarizes the presentations at a symposium exploring the effectiveness of Phase III of the SBIR program (the commercialization phase), during which innovations funded by Phase II awards move from the laboratory into the marketplace. No SBIR funds support Phase III; instead, to commercialize their products, small businesses are expected to garner additional funds from private investors, the capital markets, or from the agency that made the initial award.

Book excerpt: "While global trade negotiations remain stalled, two tracks of trade negotiations in the Asia-Pacific--the proposed Trans-Pacific Partnership (TPP) agreement and a parallel Asian track--could generate momentum for renewed liberalization and provide pathways to region-wide free trade. We estimate that world income would rise by $295 billion per year on the TPP track, by $766 billion if both tracks are successful, and by $1.9 trillion if the tracks ultimately combine to yield region-wide free trade. The tracks are competitive initially but their strategic implications appear to be constructive: they generate incentives for enlargement and mutual progress and, over time, for region-wide consolidation. The "21st century" template of the TPP would be especially productive because it is likely to offer opportunities for the leading sectors of both emerging-market and advanced economies. An ambitious TPP template would generate greater gains from integration than less demanding alternatives, but it will be harder to sell to China and other key regional partners as the TPP evolves toward wider agreements.
