Book The Genuine Book of Nullification

Download or read book The Genuine Book of Nullification written by Francis Wilkinson Pickens and published by DigiCat. This book was released on 2022-07-21 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book covers the idea of nullification, which in United States constitutional history, is a legal theory that a state has the right to nullify, or invalidate, any federal laws which that state has deemed unconstitutional with respect to the United States Constitution (as opposed to the state's own constitution). The theory of nullification is based on a view that the states formed the Union by an agreement (or "compact") among the states, and that as creators of the federal government, the states have the final authority to determine the limits of the power of that government. Under this compact theory, the states and not the federal courts are the ultimate interpreters of the extent of the federal government's power. Under this theory, the states therefore may reject, or nullify, federal laws that the states believe are beyond the federal government's constitutional powers. The related idea of interposition is a theory that a state has the right and the duty to "interpose" itself when the federal government enacts laws that the state believes to be unconstitutional. Thomas Jefferson and James Madison set forth the theories of nullification and interposition in the Kentucky and Virginia Resolutions in 1798.

Download or read book American Nationalisms written by Benjamin E. Park and published by Cambridge University Press. This book was released on 2018-01-11 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: America was born in an age of political revolution throughout the Atlantic world, a period when the very definition of 'nation' was transforming. Benjamin E. Park traces how Americans imagined novel forms of nationality during the country's first five decades within the context of European discussions taking place at the same time. Focusing on three case studies - Massachusetts, Pennsylvania, and South Carolina - Park examines the developing practices of nationalism in three specific contexts. He argues for a more elastic connection between nationalism and the nation-state by demonstrating that ideas concerning political and cultural allegiance to a federal body developed in different ways and at different rates throughout the nation. American Nationalisms explores how ideas of nationality permeated political disputes, religious revivals, patriotic festivals, slavery debates, and even literature.

Book The Nullification Controversy in South Carolina Classic Reprint

Download or read book The Nullification Controversy in South Carolina Classic Reprint written by Chauncey Samuel Boucher and published by . This book was released on 2015-07-12 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Nullification Controversy in South Carolina To relate the story of the nullification controversy in South Carolina as it is found in the writings of the men who were participants in it, is the object of this monograph. For six years the conflict was bitterly waged and missed being civil war by a narrow margin. So much attention has been given to speculations on the theory of nullification from the standpoint of political science, that the history of the party contest has been neglected; and even from the theoretical viewpoint a detailed study of the views of the contemporaneous supporters and opponents of the doctrine has been neglected. The effort has been made in this treatise to delineate the various shades of party beliefs at all stages of the controversy.
