Book excerpt: Citizenship of the Union and Freedom of Movement of Persons, sets out to analyse in detail the various provisions of Community law which confer upon individuals the right to move about, reside and work in the Member States. It also examines the procedural safeguards which set those fundamental rights apart from any deriving from other international bodies or organisations and point up the originality of the Community system. Citizenship of the Union entails freedom of movement under the current Treaties and also under the Treaty of Lisbon, in which the unified treatment of the rules, by contrast with the existing pillars of Community and European Union law, might be expected to confer new impetus on the realisation of the area of freedom, security and justice. If there is truly to be such an area, there must be unified, not merely coordinated action. Judicial cooperation must be tightened in favour of the Union and, more importantly, individuals, be they Community citizens or indeed nationals of third countries, given the increasing trend towards a kind of integration which focuses less on formal data such as nationality and more on factors such as residence, employment and social integration. The book pays particular attention to this last aspect and its political and legal implications. The "communitarisation" of immigration policy (the new Title IV of the EC Treaty mentioned above) and the perspectives opened up by the enlargement to 27 Member States (and more) and by the Treaty of Lisbon, provide the framework for the treatment given in the present work.

It identifies the challenges that a quota on EU citizens' free movement rights to Switzerland would pose to EU-Swiss relations, considering: i) the value of freedom of movement in the EU and its indivisibility from the internal market and other economic freedoms; ii) the specificity of the EU legal system following the Lisbon Treaty that has established specific democratic and judicial accountability mechanisms; iii) the lack of supranational judicial oversight of the EU-Switzerland agreements framework; and iv) the existence of the so-called guillotine mechanism, according to which the termination of the Free Movement Agreement would entail the automatic termination of the other agreements with the EU.

Book excerpt: Although it is one of very few countries in Europe that has chosen to remain outside the EU, Switzerland is closely integrated with the Union. Two sets of recently negotiated bilateral sectoral agreements provide further integration. This study analyzes the functioning of the bilateral agreements between Switzerland and the EU, focusing on the agreements that entered into force in 2002. Particular attention is paid to the institutional arrangements and their ability to adapt to new legal and political developments in the EU, the impact on the functioning of Swiss democracy, and how the Swiss political system affects the implementation of the agreements. Comparison is also made with the experiences of the European Economic Area, the only arrangement for integration without membership that is more extensive than the Swiss model. The study concludes with an assessment of the prospects for EU-Swiss relations.

The author begins by summarizing the main steps in this special and evolving relationship which has long oscillated between membership and marginalization. It contains four freedoms that guarantee free movements of goods, services, capital and people. With a possession of 4.325 Mio. km2 and 493 Mio. citizens it is one of the biggest internal markets on earth. Due to the omitted border formalities people are free to choose their place of residence, university and work place. But also the increasing quantity of goods followed by much more competition on the market in the EU leads to a price advantage for the consumers and therefore to a competitive position on the international market. Furthermore, the European Union framed some rules and additives to regulate the domestic market, like the implementation of a single currency in year 2001. In addition particular minimum standards, common standards for the environment, energy political measures, arrangements for consumer protection, a common transport policy, research funding as well as a solidary contribution for less developed Member States exist or are in process in the new regions which now belong to the EU. But there is still plenty of room for improvement with regard to the implementation of these regulations. Actually critics suppose that the transformation of normal markets in different countries into an internal market for all countries is a dubious method with incidental negative ancillary effects with unpredictable extents for the future. On account of this, the Research Paper primarily implies an explanation of the four freedoms of the European Union’s Single Market considerably. Secondly the main advantages as well as the disadvantages of the internal European trade are carved out and analysed.
