Book Railroads and Land Grant Policy

Download or read book Railroads and Land Grant Policy written by Lloyd J. Mercer and published by Elsevier. This book was released on 2013-10-22 with total page 285 pages. Available in PDF, EPUB and Kindle. Book excerpt: Railroads and Land Grant Policy: A Study in Government Intervention attempts to replace a major part of the railroad land grant legend (according to which the granting of federal and state land to private railroad firms benefitted these firms more than it contributed to society as a whole) with some real numbers and analysis. An attempt is made to put the income and wealth distribution impact of the railroad land grants in perspective, but thorough analysis of this issue is not undertaken. The primary question this study does try to illuminate is that of the effect of the railroad land grants on economic efficiency. This emphasis was chosen because it seems clear that improvement of economic efficiency was the major goal that Congress and various state legislatures sought to attain, and thus the examination of economic efficiency questions is fundamental to evaluation of railroad land grant policy. This study will not completely replace the railroad land grant legend (because much is not covered here), but it does represent a considerable diminution of that legend.

Book The Legal History of Federally Granted Railroad Rights of Way

Download or read book The Legal History of Federally Granted Railroad Rights of Way written by Darwin P. Roberts and published by . This book was released on 2009 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the nineteenth and twentieth centuries, the United States government granted railroads thousands of miles of rights of way out of the federal public lands. Court decisions, led by an influential 1942 opinion by the United States Supreme Court, have held that there was a major shift in federal right of way granting policy in 1871, the year that the federal government ceased granting checkerboard land subsidies to railroads. Courts have held that as a consequence, the federal government has retained only limited rights in railroad rights of way that it granted after 1871. The courts have upheld Fifth Amendment takings claims against the government's reuse of such rights of way for purposes such as rail trails. This article contends that there is no historical evidence for an 1871 shift in federal right of way law, and that the Supreme Court erred when it held that there was such a shift. Based on a review of the history of federal railroad right of way grants and federal railroad land subsidy grants, it concludes that federal right of way grants were part of a Congressional policy that was consistent both before and after 1871. Under that policy, the federal government did not grant railroads full title to their federally granted rights of way. Instead, the government retained ownership and/or control of those rights of way sufficient to control their disposition if later abandoned by the railroads. It concludes, therefore, that the United States government should not be liable for Fifth Amendment takings claims based on new uses of federally granted railroad rights of way.

Book The Future City on the Inland Sea

Download or read book The Future City on the Inland Sea written by Eric D. Olmanson and published by . This book was released on 2007 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout the nineteenth century, the southern shores of Lake Superior held great promise for developers imagining the next great metropolis. These new territories were seen as expanses to be filled, first with romantic visions, then with scientific images, and later with vistas designed to entice settlement and economic development. The Future City on the Inland Sea describes the attempts of explorers under government, commercial, or scientific sponsorship to project their imaginative visions on a region where the future did not happen as planned. Author Eric D. Olmanson takes a fresh look at the settlements in the vicinity of Chequamegon Bay and the Apostle Islands by analyzing the texts and images left by the missionaries, geologists, ordinance surveyors, newspaper editors, and boosters. The Future City on the Inland Sea shows how new visions of the place absorbed and replaced the old ones, eventually producing what might be called for the first time "a region." More than a regional geography, The Future City on the Inland Sea is an appraisal of these early efforts to meld geographies of physical nature with those of human ideals, a demonstration of how thoroughly and paradoxically those two realms are entangled.
