More precisely, it examines the extent to which the European Union and its Member States bear responsibility for the violations of an international agreement committed as a consequence of the implementation of EU Law. The specific features of the multilevel system implementation of EU Law poses a series of very interesting questions as regards the EU's relations with its Member States and their responsibility under International Law. The EU primarily implements its law through its Member States' authorities. As such, should the EU bear responsibility for a violation committed by a Member State organ because it was implementing EU Law? Should a Member State which, in complying with a piece of EU legislation, violated an international obligation be held liable? This thesis examines these questions from a practical perspective. It examines how international bodies approach the issue. In this regard, the thesis sets out to examine whether there is a common thread in the way international courts and tribunals deal with the EU's international responsibility. The thesis is structured in four parts. Part I identifies the basic issues surrounding the responsibility of the EU and its Member States under international law, by examining the context and the main issues both at the international level and domestic level. Part II of the thesis focuses on the main mechanism used by the EU to deal with its international responsibility. More specifically it addresses the question of whether the division of competence is a good way to establish the EU's responsibility under an international agreement. Part III of the thesis continues with a practical examination of the EU's responsibility. It examines how international courts and tribunals establish the EU's international responsibility in absence of any declaration limiting its competence. Part IV summarizes the conclusions of Parts I, II and III and contains a series of concluding remarks on the issue of the EU's international responsibility and future developments.

Book excerpt: The European Union (EU) is a political and economic partnership that represents a unique form of cooperation among sovereign countries. The EU is the latest stage in a process of integration begun after World War II, initially by six Western European countries, to foster interdependence and make another war in Europe unthinkable. The EU currently consists of 28 member states, including most of the countries of Central and Eastern Europe, and has helped to promote peace, stability, and economic prosperity throughout the European continent. The EU has been built through a series of binding treaties. Over the years, EU member states have sought to harmonize laws and adopt common policies on an increasing number of economic, social, and political issues. EU member states share a customs union; a single market in which capital, goods, services, and people move freely; a common trade policy; and a common agricultural policy. Nineteen EU member states use a common currency (the euro), and 22 member states participate in the Schengen area of free movement in which internal border controls have been eliminated. In addition, the EU has been developing a Common Foreign and Security Policy (CFSP), which includes a Common Security and Defense Policy (CSDP), and pursuing cooperation in the area of Justice and Home Affairs (JHA) to forge common internal security measures. Member states work together through several EU institutions to set policy and to promote their collective interests. In recent years, however, the EU has faced a number of internal and external crises. Most notably, in a June 2016 public referendum, voters in the United Kingdom (UK) backed leaving the EU. The pending British exit from the EU (dubbed "Brexit") comes amid multiple other challenges, including the rise of populist and to some extent anti-EU political parties, concerns about democratic backsliding in some member states (including Poland and Hungary), ongoing pressures related to migration, a heightened terrorism threat, and a resurgent Russia. The United States has supported the European integration project since its inception in the 1950s as a means to prevent another catastrophic conflict on the European continent and foster democratic allies and strong trading partners. Today, the United States and the EU have a dynamic political partnership and share a huge trade and investment relationship. Despite periodic tensions in U.S.-EU relations over the years, U.S. and EU policymakers alike have viewed the partnership as serving both sides' overall strategic and economic interests. EU leaders are anxious about the Trump Administration's commitment to the EU project, the transatlantic partnership, and an open international trading system-especially amid the Administration's imposition of tariffs on EU steel and aluminum products since 2018 and the prospects of future auto tariffs. In July 2018, President Trump reportedly called the EU a "foe" on trade but the Administration subsequently sought to de-escalate U.S.-EU tensions and signaled its intention to launch new U.S.-EU trade negotiations. Concerns also linger in Brussels about the implications of the Trump Administration's "America First" foreign policy and its positions on a range of international issues, including Russia, Iran, the Israeli-Palestinian conflict, climate change, and the role of multilateral institutions. This report serves as a primer on the EU. Despite the UK's vote to leave the EU, the UK remains a full member of the bloc until it officially exits the EU (which is scheduled to occur by October 31, 2019, but may be further delayed). As such, this report largely addresses the EU and its institutions as they currently exist. It also briefly describes U.S.-EU political and economic relations that may be of interest.

Book excerpt: This book examines the various minorities living in the island of Cyprus from the early modern (late Venetian and early Ottoman) period down to the present day. It charts their history, with special emphasis on their relations with the powers ruling Cyprus and with the two dominant Christian-Greek and Muslim-Turkish communities. The theme running through the book is that despite being significant members of Cyprus’ society, the three historical minorities (Maronites, Armenians and Latins) were only included in society to a certain extent by the two major communities. This was formalised in the post-independence (1960) period when they were compelled to become members of either dominant community and thus they suffered ‘internal exclusion’ by being regarded as religious sub-groups of one of the two dominant communities rather than national minorities in their own right. Within this general context, the social, legal and political roles, customs, culture and language of the various minorities are examined as they evolved through time and in response to internal and external developments affecting Cyprus in the political, economic and global spheres. They are discussed not as static entities, but as evolving groups that have adapted with greater or lesser degrees of success to the radical and at times painful changes Cyprus has undergone, especially over the last 150 years, in all walks of life. Finally, the question of what the future holds for the minorities of the island in the light of Cyprus’ EU membership and the prospect of reunification are also analysed. The contributors theoretically engage with both rationalist and constructivist accounts of middle-power. They reveal that the end of the Cold War, the advent of globalization, and the rise in institutionalized regional cooperation have increased ItalyÆs freedom to maneuver. At the same time, however, these changes have decreased ItalyÆs policy freedom as a result of delegation of policy competencies to the European Union and the need for cooperation in a globalized world. Domestic changes, notably the transition from the First to the Second Republic and the transformation of political leadership under Prime Minister Silivio Berlusconi, have altered the way domestic politics is played out in foreign policy. Rather than adopting the more common focus on ItalyÆs bilateral relations with other counties or regions, this collection centers on actors, issues and policy instruments in vital areas of ItalyÆs foreign policy. In addition, it discusses the search for ItalyÆs position in global affairs and emphasized the importance of leadership styles, domestic political agendas, and party rhetoric in determining ItalyÆs foreign policy. Book excerpt: This book represents a unique endeavor to elucidate the story of Kosovo’s unilateral quest for statehood. It is an inquiry into the international legal aspects and processes that shaped and surrounded the creation of the state of Kosovo. Being created outside the post-colonial context, Kosovo offers a unique yet controversial example of state emergence both in the theory and practice of creation of states. Accordingly, the book investigates the legal pathways, strategies, developments and policy positions of international agencies/actors and regional players (in particular the EU) that helped Kosovo to establish its independence and gradually acquire statehood. Although contested, Kosovo, and its quest for statehood, represents a unique example of successful unilateral secession. The book therefore explores and analyses patterns of state formation and nation-building in Kosovo, and its transition to democracy. It presents a three-level assessment. First, seen from a historical perspective, the book examines the validity of the right of Kosovar-Albanians to self-determination and remedial secession. Second, from a legal positivist perspective, it scrutinizes all of the legalist arguments that support Kosovo’s right to statehood, and claims that both traditional and legality-based criteria for statehood remain insufficient to determine whether Kosovo has achieved statehood. Third, from a post-factum perspective, the book analyzes the scope and extent to which the internationally blended element was decisive in Kosovo’s state-formation and state-building processes. It explains how the EU’s involvement as an ‘internationally blended element’ in Kosovo’s efforts to achieve statehood was instrumental and played a crucial role in shaping the emerging state. In particular, the book elaborates on how the EU was able to streamline its mode of intervention in the context of state-building and reform.
