Book excerpt: This book addresses the contentious debate surrounding the future of the European Atomic Energy Community Treaty (Euratom), one of the European Union’s founding treaties. Arguing that it has remained at a ‘crossroads’ since its adoption in 1957, Anna Södersten explores the issue of whether the treaty should be kept separate from the EU, or be brought within its framework.

Book Handbook on European Nuclear Law

Download or read book Handbook on European Nuclear Law written by Rasa Engstedt and published by Kluwer Law International B.V.. This book was released on 2020-11-27 with total page 472 pages. Available in PDF, EPUB and Kindle. Book excerpt: Energy and Environmental Law and Policy Series #39 While the European Economic Community has evolved through the decades into the legal entity of the European Union, the substantive law contained in the 1957 Euratom Treaty has never been amended. Recurring legal discussions of the treaty’s potentially obsolete nature give rise to this much-needed handbook, which provides systematic analysis and evaluation of the competences conferred under the Euratom Treaty. Following the structure of the Euratom Treaty, the author analyses and evaluates the scope, content, exercise, and case law of the Euratom Communities’ competences in the following fields: Promotion of research, with reference to the Horizon research programmes; dissemination of information; health and safety, including environmental protection; investments; joint undertakings; nuclear supplies; safeguards; property ownership of fissile materials; the nuclear common market; and the Community’s external relations. The book deals with issues of stagnation and potential obsolescence through such lenses as the legislative amendment procedure, level of regulatory detail, quantitative elements of exercise, secondary legal acts, and the Court of Justice of the European Union’s power to define and delimit the Euratom Community’s competences. The competences in the fields of military activities and State aid are also examined in detail. The role of principles of subsidiarity and proportionality in European nuclear law and the issue of classification of competences under the Euratom Treaty are addressed in this book. With its systematic, chapter-by-chapter analysis of competences of the Euratom Community under the Euratom Treaty, the book will be welcomed by lawyers and negotiators working in nuclear field, researchers in nuclear law and in the broader competences of the EU, and policymakers in the European nuclear sector. “This book represents an important contribution to the renewed academic discourse on the Euratom Community. I would like to recommend it both to those looking for concise information on this neglected Community as well as to those dealing with the topic of competences with respect to the law of the EU. It is also vital reading for policymakers and lawyers active in the field of energy and nuclear law” Jakub Handrlica, Common Market Law Review (2021)

Available in PDF, EPUB and Kindle. Book excerpt: This open access book discusses the eroding economics of nuclear power for electricity generation as well as technical, legal, and political acceptance issues. The use of nuclear power for electricity generation is still a heavily disputed issue. Aside from technical risks, safety issues, and the unsolved problem of nuclear waste disposal, the economic performance is currently a major barrier. In recent years, the costs have skyrocketed especially in the European countries and North America. At the same time, the costs of alternatives such as photovoltaics and wind power have significantly decreased. Book The European Atomic Energy Community in the European Union Context

Download or read book The European Atomic Energy Community in the European Union Context written by Ilina Cenevska and published by BRILL. This book was released on 2016-04-26 with total page 366 pages. Available in PDF, EPUB and Kindle. Book excerpt: Ilina Cenevska’s new book, The European Atomic Energy Community in the European Union Context: The 'Outsider' Within explores the unique nature of the Euratom Community as an entity that establishes a supranational regulation in the civil nuclear industry, which, while formally belonging to the European Union construct, is coincidentally somewhat kept ‘outside’ the mainstream developments in the Union. The book surveys Euratom’s status as an ‘outsider within’ the European Union through the correlation between the principles and mechanisms particular to the functioning of the Euratom legal framework and those devised under the Union framework stricto sensu, focusing on two specific areas - nuclear safeguards and health and safety in the nuclear domain.

Book The Exclusive Treaty Making Power of the European Community up to the period of the Single European Act

Download or read book The Exclusive Treaty Making Power of the European Community up to the period of the Single European Act written by Moshe Kaniel and published by BRILL. This book was released on 2023-07-24 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book sheds light on a fascinating process of historic, legal evolution, starting from a situation of doubt as to whether the Community had treaty-making power, and ending with certain treaties being denied to sovereign states and transferred to an international organization. This process is still continuing, and brings in its wake far-reaching results. The author makes distinction between cases where exclusive treaty-making is explicitly specified in the founding treaties, and cases where treaty-making power is implicit, and is derived from the general structure of Community law. Implicit power becomes exclusive only by `occupying the field', which means enactment, and exclusive power negates ab initio the Member States' power, whereas implicit exclusive power merely negates the competence of the Member States to establish rules conflicting with those of the Community. Scholars, practitioners, lawyers, students and everybody who deals with European Union affairs will find this book of great interest.

Book The Politics of Nuclear Energy in the European Union

Download or read book The Politics of Nuclear Energy in the European Union written by Pamela Mary Barnes and published by Verlag Barbara Budrich. This book was released on 2018-04-23 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: For the foreseeable future the overall use of nuclear electricity in the European Union is unlikely to change significantly despite the controversies surrounding its use amongst the EU’s nation states. The author questions the role that nuclear electricity plays in meeting the challenges of providing secure, competitive and sustainable energy to support the development of the low carbon economy in the EU. Analysis presented focuses on the evolution of the discourse on nuclear energy amongst policy makers at European and national levels as well as amongst the public.
