Book excerpt: Recent events in North Africa and the Mediterranean have had consequences in terms of human mobility, and are putting the foundations and components of EU's migration policy under strain. The forthcoming European Council summit of 23-24 June 2011 is expected to determine 'the orientations for further work' under the Polish Presidency and the next JHA Trio Presidency Programme for the EU's policies on crossborder migration in the Mediterranean and internal mobility within the scope of the Schengen regime. This paper constitutes a contribution to current and future EU policy discussions and responses on migration, mobility and security. It provides a synthesised selection of recommendations in these domains resulting from the research conducted by the Justice and Home Affairs (JHA) Section of the Centre for European Policy Studies (CEPS) during the last nine years of work. This Policy Brief argues that for the EU's Global Approach to Migration to be able to satisfactorily address its unfinished elements and policy incoherencies, the Union needs to devise and develop common policy strategies focused on: first, new enforcement and independent evaluation mechanisms on the implementation of the European law on free movement, borders and migration, and the compatibility of EU member states and EU agencies' actions with the EU Charter of Fundamental Rights. And second, the development of a kind of cooperation (dialogue) with third states that goes beyond security-centred priorities and that is solidly based on facilitating human mobility, consolidating fundamental rights and the general principles of the rule of law upon which the EU legal system is founded.

Migration as a civilizational phenomenon, albeit transitional, goes across this entire spectrum, particularly in a varied historical milieu as the Euro Mediterranean region is. In turn, reforms and changes need to be carried out by South Mediterranean states and societies, in order to eliminate some of the obstacles to modernization, creating conditions for economic development at home with the help of North Mediterranean countries. Another package of reforms in European countries should empower migrants to adopt a more active citizenship and become more integrated in the societies where they choose to live. For Khachani, one of the editors of the book, a demystification of the question of migratory risk is in order to foster an improved dialogue between south Europe countries and North Africa countries. Sending countries are affected by political crises, socio-economic instability, and illegal migration from North Africa; receiving countries practice discrimination in labour market and social space.

Migration and mobility now feature as key components of High Representative Catherine Ashton's new framework for cooperation with the region (Partnership for Democracy and Shared Prosperity), while the EU has declared its intention to strengthen its external migration policy by setting up "mutually beneficial" partnerships with third countries--so-called 'Dialogues for Migration, Mobility and Security'--now placed at the centre of the EU's renewed Global Approach to Migration and Mobility (GAMM). However, the success of this approach and its potential to establish genuine cooperative partnerships that will support smooth economic and political transformation in North Africa hinge on the working arrangements and institutional configurations shaping the renewed GAMM at EU level which has long been marked by internal fragmentation, a lack of transparency and a predominance of home affairs and security actors. This paper investigates the development of the Dialogues for Migration, Mobility and Security with the Southern Mediterranean in a post-Lisbon Treaty institutional setting. It asks to what extent has the application of the Lisbon Treaty and the creation of an "EU Foreign Minister" in High Representative Ashton, supported by a European External Action Service (EEAS), remedied or re-invigorated the ideological and institutional struggles around the implementation of the Global Approach? Who are the principal agents shaping and driving the Dialogues for Migration, Mobility and Security? Who goes abroad to speak on the behalf of the EU in these Dialogues and what impact does this have on the effectiveness, legitimacy and accountability of the Dialogues under the renewed GAMM as well as the wider prospects for the Southern Mediterranean?

Although the death toll has been rising for many years, the EU response remains fragmented and short sighted. Politicians frame these migration flows as an unprecedented crisis and emphasize migration control at the EU's external boundaries. In this context, At Europe's Edge investigates why the EU prioritizes the fortification of its external borders; why migrants nevertheless continue to cross the Mediterranean and to die at sea; and how EU member states on the southern periphery respond to their new role as migration gatekeepers. The book addresses these questions by examining the relationship between the EU and Malta, a small state with an outsized role in migration politics as EU policies place it at the crosshairs of migration flows and controls. Yet, with negotiations on the establishment of Mobility Partnerships now well underway between the EU and certain Southern Mediterranean countries, the current contours of the EU's external dimensions of migration policy continue to be primarily insecurity, (im)mobility and conditionality driven. This Policy Paper seeks to explain the reasons behind the EU's migration policy responses towards the Southern Mediterranean region from the perspective of the EU's institutional setting: how do the key actors in this policy domain and their institutional relations drive and shape the EU's external migration policies? It finds an institutional setting beset by struggles for autonomy and authority to control the policy agenda within the GAMM. Despite the application of the Lisbon Treaty and the creation of a European External Action Service (EEAS), an ever-expanding "Home Affairs diplomacy", propounded by the Commission' DG Home, certain EU agencies such as Frontex and the working structures of the Council, continue to dominate policy formulation on the external dimensions of EU migration policies.

This book examines the question in relation to the performance of the European Commission's intra-institutional setting while taking stock of the most relevant legislative developments and acts in the EU Area of Freedom, Security and Justice (AFSJ) from 2014 up to the end of 2018. These developments are critically assessed in view of the rule of law and fundamental rights standards enshrined in the Treaties and the EU's Better Regulation commitments. The book argues that this has been the Commission of crisis and that the 'politics of crisis' have not benefited the Juncker Commission overall. They have allowed for greater intergovernmentalism, rule of law backsliding, informalisation and exceptionalism in EU AFSJ policies. It also considers how actors treating migration as an ordinary phenomenon rather than a threat and sharing inclusive narratives can create the conditions for decelerating and eventually stopping securitisation processes. Some chapters examine the spiralling of the securitisation of migration in depth, by analysing increases in securitisation, as well as cases characterised by resistance. The ENP is now little more than an elegantly crafted fig leaf that purports to take a soft power approach to the EU’s outer periphery, argues the author, but in effect it inclines more towards Realpolitik. By prioritising security interests over liberal values in increasingly transactional partnerships, the EU is atomising relations with its neighbouring countries. And without the political will and a strategic vision to guide relations with the neighbours of the EU’s neighbours, the ENP remains in suspended animation.
