Book excerpt: In recent years, the EU and its member states have experienced a number of changes, as well as challenges, in the areas of politics, economics, security and law. As these areas are interconnected, changes and challenges to any of them have implications for the others, as well as implications for the populations and institutions of the EU or those coming into contact with its international power and influence. This edited collection focuses primarily on security and law, particularly the EU’s internal security strategy. The EU’s Internal Security Strategy, adopted by the Spanish presidency early in 2010, followed the Lisbon Treaty in 2009, building on previous developments within the EU in the Area of Freedom Security and Justice (AFSJ) policy. The focus of the EU Internal Security Strategy is to prevent and combat “serious and organised crime, terrorism and cybercrime, in strengthening the management of our external borders and in building resilience to natural and man-made disasters”. The Internal Security strategy intersects and overlaps with the European Union’s Counter-terrorism strategy, the Strategy for the External Dimension of JHA, and the EU’s Security Strategy. The role of and interaction between these strategies, their supplementing documents, and their implications for crime, victims, the law, political relations, democracy and human rights, form the backdrop against which the chapters in this collection are written. Building on original research by its contributors, this collection comprises work by authors from a wide variety of academic and professional areas and perspectives, as well as different countries, on a variety of areas and issues related to or raised by the EU’s Internal Security Strategy, from intelligence-led policing to human trafficking and port security. This book examines, from a wide variety of disciplinary perspectives including law, geography, politics and practice, both this further refinement of existing internal provisions on cross-border crime, and the increasing external relations of the EU in the AFSJ.

While a great deal of attention has been focused on airports and passenger air travel since 9/11, in part two we have decided to concentrate on another specific but less examined location, EU commercial maritime ports. The third and fourth parts of this collection focus on two particular types of crime as case studies, commercial/financial crime and human trafficking. The fifth and final part of the book examines the bigger picture, the relationship between the EU's internal and external security policy. Within each part, the contributors examine different, but overlapping, legal, political, practical and analytical cases, themes and issues.

Book excerpt: Following the Treaty of Lisbon, The European Council has been given the power to adopt and implement an internal security strategy. it did so in March 2010, and this was followed in November by a Commission communication setting out the priorities, and how to implement them. The communication sets out five steps towards a more secure Europe: The disruption of international crime networks, The prevention of terrorism, security in cyberspace, improved border management, and increased resilience to crises and disasters. Of these cyber-security is a comparative newcomer and it is now clear that it can lead to massive disruption of state infrastructure, and can be used for espionage, terrorism, even war. As such, much of the evidence received concerned the role which the EU might play in fighting cyber-attacks. The Commission's main proposal is to set up a new Cybercrime Centre. This might be no more than a talking shop, but it could become a useful tool for investigating and analysing past attacks, improving law enforcement and preventing future attacks. Much will depend on whether it is given adequate resources. The Committee looked at the implementation of the strategy and at the way in which it overlaps with national and international strategies, In the hope that they can be mutually supportive. The Council has a new committee, which, under the Treaties, has the duty of coordinating all the work on internal security. Unless it does so effectively very little can be achieved; if it properly fulfils its mandate, The EU may play a valuable role in protecting the security of its citizens.

If the EU is to survive and prosper as an effective security actor, it requires that greater attention be devoted to taking a cohesive and common position on the relationship between EU foreign policy means and goals. The major claim of this edited collection is that there is a European grand security strategy that disciplines member state security strategies. That grand strategy has two distinct substantive goals: (1) the preservation and expansion of the EU system of security governance; and (2) the implementation of specific strategies to meet internal and external threats and sources of insecurity. The EU has sought to develop a grand security strategy that not only accounts for the proliferation of threats possessing a military or non-military character and differentiates between core and peripheral regions of interest, but also addresses the requirements to bridge the increasingly blurred boundary between internal and external security threats and the necessary reconciliation of the competing security preferences of its member states. The empirical contributions to this volume examine the EU security strategies for specific issue areas and regional threat complexes. These case studies assess whether and how those strategies have consolidated or expanded the EU system of security governance, as well as their successes and limitations in meeting the security threats confronting the EU and its member-states. This volume will be of great interest to students of EU policy, foreign policy, security studies and IR.

The Communication envisages five key strategic objectives for the EU's internal security: disrupt organised crime, prevent terrorism, raise levels of security in cyberspace, strengthen external borders management and increase the EU's resilience to natural disasters. This paper starts by critically examining the extent to which these objectives actually constitute shared common concerns in all EU 27 member states and whether they are based on independent and objective evidence. After demonstrating the contrary, we then argue that the ISS should be rather considered as an 'Internal (In)security Strategy' because of the lack of an accompanying solid rule of law and liberty strategy (model) focused on ensuring the delivery to everyone living in the EU (and who will be subject to increasing EU internal security policies focused on more surveillance, preventive measures and an intelligence-based approach) the twin rights of rule of law and fundamental rights.

Book excerpt: This book examines how internal and external security are blurring at the EU level, and the implications this has for EU security governance and the EU as a security actor. The EU claims that ‘internal and external security are inseparable’ and requires a more integrated approach. This book critically assesses this claim in relation to the threats facing the EU, its responses to them, and the practical and normative implications for EU security governance and actorness. It sets out a novel conceptual framework – the EU security continuum - to examine the ways and extent to which internal and external security are blurring along three axes: geographic, bureaucratic, and functional. This is done through an analysis of four key security issues, regional conflict, terrorism, organised crime, and cybersecurity. The book demonstrates that, to varying degrees, these security threats and/or responses do transcend boundaries. However, institutional turf wars and capability silos hamper the EU’s integrated approach and, therefore, its management of transboundary security threats. Yet, the EU’s pursuit of an integrated approach is reframing its claimed normative distinctiveness toward a more practical one, based on a transnational and multidimensional approach. Such a rearticulation, if implemented, would make the EU a genuinely transboundary security actor, properly structured and equipped to tackle the 21st century’s internal-external security continuum. This book will be of much interest to students of European Security, EU politics, and international relations.

Book excerpt: This book analyses the cooperation between the European Union and the United States on internal security and counter-terrorism since the 9/11 terrorist attacks. In particular, four areas of cooperation are examined: customs and supply chain security; judicial cooperation (the mutual legal assistance and extradition agreements); law enforcement cooperation (the Europol-US agreements); and the EU-US agreements for the sharing of air passengers’ data (PNR agreements). These cases are analysed through a conceptual framework based on the theories of international regimes, with the data being drawn from an extensive documentary analysis of media sources collected through the 'Nexis' database, official documents, and from 13 semi-structured elite interviews with US and EU officials. The book argues that the EU and the US have established a transatlantic internal security regime based on shared principles, norms, rules, and interests. While at the beginning of this process the EU had a more reactive and passive stance at the later stages both the EU and the US were active in shaping the transatlantic political agenda and negotiations. The book demonstrates how the EU has had a much more proactive role in its relations with the US than has often been assumed in the current literature. This book will be of much interest to students of EU policy, foreign policy, international security and IR in general.

European Homeland Security addresses two major debates in relation to the development of homeland security in Europe. Yet actual cooperation, when viewed closely, proceeds at a halting pace – raising questions as to why cooperation appears so problematic. This book presents a novel, theoretically-informed way to understand internal security cooperation in Europe. The approach treats internal security as a "public good" requiring collective action amongst sovereign governments. All governments must contribute to the production of a public good; once produced, the public good benefits all governments. Fundamental obstacles to producing a public good thus arise, and can help explain the underlying difficulties facing European cooperation on internal security matters. The chapters in this book apply a public goods approach to different internal security issues, ranging from terrorism to border management, and from environmental security to natural disasters. Each study demonstrates how the various goals of internal security cooperation resemble different forms of public goods – and thus present different kinds of obstacles to effective cooperation. This book fills a theoretical gap in the literature on European internal security cooperation with a proven approach increasingly used in other scholarly fields.
