The Audiovisual Media Services Directive is the bedrock of the EU's audiovisual and media policies. It regulates diverse aspects for providers of television broadcasting and on-demand services and entered into force in December 2007. Due to the volatility of a market facing convergence of media and important policy choices, for instance whether to allow product placement, Member States have struggled with the transposition of this Directive. This completely new commentary employs an innovative approach: Based on English translations, the study systematically examines the national implementing measures of the future 28 Member States (including Croatia). It sets out, article-by-article, the original provisions contained in the Directive before analysing domestic transpositions. National measures are grouped in order to reveal similarities and differences and examined for compliance with the Directive. This comparative perspective contributes to the discussions on reforms of the Directive or the EU's approach to new media services."--

Book excerpt: Audiovisual Media Services Directive (AVMSD), which provided a legal framework for traditional TV broadcasts and on-demand services, was revised in November 2018 in order to align with new developments in audiovisual technologies and on audiovisual markets. To facilitate the implementation of the AVMSD, this study looks at regulatory and business practices relating to three topics included for the first time in the EU media framework: video-sharing platforms (VSPs), media ownership and transparency, and signal integrity. Concerning VSPs, the study looks at the extent to which VSPs can and do take measures to protect minors and the public, as envisaged by the AVMSD. It also looks at developments in implementation at Member State level and the transnational dimension. The media ownership and transparency part explores approaches across the EU to constraining media concentration and promoting transparency, the extent to which current rules are sufficient and enforced, the related best practices, and whether action should be taken at EU or national level. The signal integrity part discusses the prevalence of problems with signal integrity and the conditions that need to be met for the successful implementation of the Directive.

Book excerpt: This report analyses the implementation of Articles 13, 16 and 17 of the Audiovisual Media Services Directive (AVMSD). These articles concern the promotion of European works by broadcasters and video on demand service providers. The study is part of the regular monitoring which is also requested by the Directive. The report covers the period of 2015-2019 and therefore the version of the legal provisions that were valid during that time. This means that the amendments of Articles 13, 16 and 17 introduced in the 2018 revision of the AVMSD, which entered into force in 2020, are not reflected in this research. The study had these three objectives: - Map existing legislation and practices in Member States; - Provide insights on the developments in the audiovisual market; and - Analyse the content offer on both linear broadcasting and on-demand services. The study is based on the following main sources of information: - legal analysis of the audiovisual legal framework and its evolution in the 27 EU Member States, UK, Norway and Iceland. This analysis was undertaken with the support of independent legal experts from all the covered countries; - reporting about the share of European works in linear services and in VoD services based on the data provided by EU Member States. EU Member States' data was accompanied by short reports providing additional information, explaining the national monitoring measures as well as explaining any measures taken to tackle cases of non-compliance by service providers; - data from Eurostat and Orbis dataset about the audiovisual sector and its sub-sectors; - programming data of 467 linear service channels in 11 EU Member States. For these channels the Electronic Programming Guides data was scraped for a period of 3 consecutive months and subsequently analysed to assess the content offer; - catalogues of 751 video on demand (VoD) services in 21 EU Member States + Norway; - qualitative key informant interviews in 11 countries and at EU level.

Book excerpt: The current ongoing revision of the EC's Television without Frontiers (TVwF) Directive clearly raises major questions for the future of the regulation of linear and non-linear services. However, it also gives rise to reflection concerning the Council of Europe's European Convention on Transfrontier Television (ECTT), a parallel regulatory instrument concerning cross-border broadcasting. At a time of major transformation of the European legal instruments which are applied to broadcasting and new audiovisual services, this new report from the European Audiovisual Observatory takes stock of recent and current problem areas in broadcasting regulation in the light of the challenges these will raise for the new extended regulation. The report analyses issues of the practical application of the TVwF Directive and the ECTT in their current form. It also raises the question of the future cohabitation of the two instruments following the completed revision of the TVwF Directive, not forgetting that there will clearly be a period where the two instruments will be "out of phase" with each other.
