EC note: In these Regs, regulation 3(3) amends the definition of "Directive"in the 2006 Regulations, which implemented Directive 2002/49/EC relating to the assessment and management of environmental noise, by adding the words "as amended from time to time". The amendment was made in reliance on the power para. 1A of Sch. 2 to the European Communities Act 1972. The effect of the amendment meant that all of the references to the Directive in the 2006 Regulations were to be construed as references to the Directive as amended from time to time in the future. This is referred to as an ambulatory reference. These Regulations ensure that the scope of the ambulatory reference is limited to references in the 2006 Regulations to Annexes I and VI and paragraph 7 of Annex IV of the Directive (regulation 2(2)(b))
