Federal agencies have not yet identified all contaminated facilities or characterized the extent of contamination. Moreover, remediation costs vary greatly depending on the technology employed and the cleanup standard. If regulatory policies require that destructive technologies are used to meet pristine cleanup levels, remediation costs will be far greater than if containment technologies are used to mitigate gross public health threats. By any estimation, however, the costs of cleaning up contaminated federal facilities will be immense. One major concern of potential participants in federal facility cleanups, however, is their liability for environmental damages arising during the course of work. Traditionally, companies relied on commercial liability insurance to offset contingent liabilities, including environmental harms. Insurance costs, in turn, were typically reimbursed under government contracts. During the 1980's, however, commercial insurance for pollution damage became prohibitively expensive -- where it was available at all. In response to contractor concerns about liability and warnings that qualified, solvent contractors would not bid on contracts that carried the potential for significant uninsured losses, federal agencies and Congress developed several mechanisms to reduce, if not eliminate, the risks faced by government contractors.

Book excerpt: Pursuant to a congressional request, GAO reviewed Department of Defense (DOD) efforts to clean up environmental damage on DOD-owned property, focusing on: (1) cleanup costs at contaminated facilities; and (2) the DOD approach for sharing cleanup costs between the government and other parties. GAO found that: (1) environmental cleanup at DOD government-owned, contractor-operated (GOCO) plants and the Rocky Mountain Arsenal will generally take longer and cost about $3 billion, 70 percent more that DOD reported; (2) liability for cleanup falls on a variety of potentially responsible parties, including facility operators and generators of hazardous substances; (3) each of the services and the Defense Logistics Agency has a different policy on cost-sharing for environmental cleanups; (4) Environmental Protection Agency policy states that status as a GOCO operator does not shield a contractor from environmental liability; (5) the military services have not requested that GOCO operators share in the cost of cleaning up past contamination; (6) cleanup is managed by the Army Corps of Engineers at former defense sites and former GOCO facilities sold to the private sector; and (7) a contribution of about $250 million has been obtained from the lessee at the Rocky Mountain Arsenal.

Book excerpt: The estimated cost to the federal government of cleaning up environmental contamination, referred to as environmental liabilities, was $613 billion in fiscal year 2021. This is an increase from $465 billion in fiscal year 2017. DOD's fiscal year 2021 share of environmental liabilities was the second highest among federal agencies, at about $82 billion. Federal law authorizes DOD to identify, investigate, and clean up contamination from hazardous substances and military munitions that it caused on properties used for military purposes and that were conveyed out of DOD's jurisdiction prior to 1986. These types of contamination can harm both humans and the environment. . Among other objectives, this report (1) describes the scope and costs of cleaning up FUDS and the reliability of the estimates and (2) examines how DOD selects FUDS for cleanup. GAO recommends that DOD (1) develop guidance to weigh the relative risk between IRP and MMRP sites and (2) establish a relevant cleanup goal for the FUDS MMRP program.
