In this tradition, the character of the “sovereign” or “lawgiver” has provided the solution to this problem. But how does the sovereign acquire the right to found law? As soon as we ask this question we are immediately confronted with a convoluted combination of jurisprudence and theology. The author begins by tracing a lengthy and deeply nuanced exchange between Derrida and Nancy on the question of community and fraternity and then moves on to engage with a diverse set of texts from the Marquis de Sade, Saint Augustine, Kant, Hegel, and Kafka. These texts—which range from the canonical to the apocryphal—all struggle in their own manner with the question of the foundations of law. Each offers a path to the law. If a reader accepts any path as it is and follows without question, the law is set and determined and the possibility of dialogue is closed. The aim of this book is to approach the foundations of law from a series of different angles so that we can begin to see that those foundations are always in question and open to the possibility of dialogue.

For decades, that structure has been the subject of intense debate between formalists, who say that transactional law is a private law for interacting parties, and functionalists, who say that it is a public law serving the collective ends of society. Against both camps, Brudner proposes a synthesis of formalism and functionalism in which private law is modified by a common good without being subservient to it. Drawing on Hegel's legal philosophy, the author exhibits this synthesis in each of transactional law's main divisions: property, contract, unjust enrichment, and tort. Each is a whole composed of private-law and public-law parts that complement each other, and the idea connecting the parts to each other is also latently present in each. Moreover, Brudner argues, a single narrative thread connects the divisions of transactional law to each other. Not a row of disconnected fields, transactional law is rather a story about the realization in law of the agent's claim to be a dignified end-master of its body, its acquisitions, and the shape of its life. Transactional law's divisions are stages in the progress toward that goal, each generating a potential developed by the next. Thus, contract law fulfils what is incompletely realized in property law, negligence law what is germinal in contract law, public insurance what is seminal in negligence law, and transactional law as a whole what is underdeveloped in public insurance. The end point is the limit of what a transactional law can contribute to a life sufficient for dignity. Reconfigured and expanded with a contribution by Jennifer Nadler, The Unity of the Common Law stands out among contemporary theories of private law in that it depicts private law as purposive without being instrumental and as autonomous without being emptily formal.

Book excerpt: This dissertation examines how different perspectives on apocalypse and catastrophe allow for alternative understandings of the formation and importance of community through an examination of intersections among race, religion, culture, and politics in apocalyptic texts and rhetoric in late 20th- and early 21st-century United States literature. Using texts such as Octavia Butler's Parable of the Sower, Tim LaHaye and Jerry B. Jenkin's Left Behind: A Novel of the Earth's Last Days, Louise Erdrich's Future Home of the Living God, and Matthew Mather's Cyberstorm, I analyze how apocalypse narratives serve a myriad of functions that center around contradictory understandings of the function of community. An understanding of apocalypse as a deserved and inevitable consequence of bad, individual human behavior is one persistent definition, from U.S. Puritan days to the present. Although it is important to see how this definition continues to have power in contemporary culture, I also analyze apocalypse as an ongoing process shaped by racism, genocide, and violence firmly rooted in a settler colonialist and imperialist system that depends on structures of inequality. This is ultimately important because ideas about apocalypse impact the way U.S. empire is understood: either as a naturalized structure that rewards those who recognize and change their behavior, or alternatively, as a structure that people have created, and that people can change, which stigmatizes and punishes those on the outside of U.S. empire. By reframing apocalypse in this manner, I transform it into a generative category of analysis for understanding the U.S. empire as well as anti-imperialist writers and movements. A deeper re-consideration of the apocalypse genre, with special attention to intersections among race, religion, and gender, can help us understand how theorizing and practicing community is key to survival and a hopeful, more equitable future.

Book excerpt: The author of Hebrews is arguing that God himself has brought about the fulfillment of these institutions through his Son's priesthood, his once-for-all sacrifice, and the new covenant he inaugurated in the last days. These new institutions are never denied the Jews. In fact, the context of the epistle presumes that these are primarily for the Jews, considering that the author was speaking to a Jewish-Christian community. The author is not arguing for the abandonment by God of the Jewish people, but rather for the abandonment of the shadowy means by which God's people drew near to him. It is here we can speak of a qualified supersessionism. According to the author of Hebrews, the Levitical priesthood, the Mosaic covenant, and the Levitical sacrifices have been superseded by Jesus' priesthood, the new covenant, and Jesus' once-for-all sacrifice. However, we conclude that the polemical passages in Hebrews do not promote hatred of the Jews, nor do they advocate the destruction of the Jewish people. Rather, the author of Hebrews stresses the fulfillment of specific Jewish institutions for the benefit of the Jews. It is this idea of fulfillment that rules out the charge that the epistle promotes the supercession of the Jewish people.
