Co., 51 mo. 191, that contributory negligence is a matter of defense, and that the onus of establishing it is on the defendant, and the rule has been reiterated in the late case of Stephens v. Macon, 83 Mo. 345. If the onus of proving contributory negligence, or of knowledge on the part of the plaintiff of defective ma chinery, rests on the defendant, it would be a singular rule of pleading to require a plaintiff to aver negatively that he was not guilty of contributory negli gence, or did not have knowledge of defective machinery; neither one of which he would be required to prove to make out his case. The jurors for our Lady the Queen upon their oath present that heretofore, to wit, in the year of our Lord 1885, one Arthur Bagley feloniously did steal, take and carry away certain money, to wit, to the amount of 285. Of the moneys of Henry Bedford, against the peace of our said Lady the Queen, her crown and dignity; and that i/villiam Henry Burgess, well knowing the said felony to have been done and committed by the said Arthur Bag/ey as aforesaid, and contriving and intending to per vert the due course of law and justice, and to cause and procure thesaid Arthur Bagley for the felony aforesaid to escape with im punity, afterwards, to wit, on the 5th day of july, in the year aforesaid, in the county of Surrey, and within the jurisdiction of the said court, unlawfully and for gain's sake did compound the said felony with the said Arthur Bagley, and did then exact, take, receive and have from the said Arthur Bagley the sum of 285. For and as a reward for com pounding the said felony, and desisting from prosecuting the said Arthur Bagley, and for procuring that the said Arthur Bagley should not be prosecuted for the felony aforesaid, to the great hindrance of justice, in contempt of our said Lady the Queen and her laws, and against the peace of our said Lady the Queen, her crown and dignity. As the Code is, the pleading in such a case is cramped down to all the strictness of a common law plea; this is, however, impossible, and must be changed. The Code in this respect is wholly disregarded in practice. The swearing to pleadings is no aid to the administration of jus tice. Experience has settled this, both here and in New York. In actions on contracts for the payment of money only, the defendant might be required to swear to his answer, in case the plaintiff swore to his petition.
