This book was released on 2017-10-17 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Essentials of American Constitutional Law But principles are not numerous. Possibly in Nature there is but one basic principle and all our so-called natural laws are but aspects of that principle as the human mind conceives or recognizes it. The analogy in government permits the asser tion that the principles of constitutional law are few. Possibly they are severally aspects of one principle: that of sovereignty. To the student of the law, especially to junior students, principles are matters of memory rather than of understanding. It is a vigorous and essentially mature mind that can reduce a complex issue to such simple form as to deduce the principle on which it rests. Download or read book Principles of the Constitutional Law of the United States Classic Reprint written by Westel W. Willoughby and published by Forgotten Books. This book was released on 2015-09-27 with total page 662 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of the Constitutional Law of the United States This volume is an abridgment of the author's larger treatise in two volumes, published in 1910 under the title The Constitutional Law of the United States. The aim has been to present the general principles of our constitutional jurisprudence in a form suitable for class-room use. In pursuance of this aim care has been taken to cite those cases which not only support the positions stated in the text but which Will best repay individual examination and study by the student. In particular the effort has been made to suggest, and in a measure to discuss, the unsettled questions of our Federal jurisprudence. The necessary limits of space have prevented in many instances an adequate presentation of the arguments supporting the doctrines stated, but, from a pedagogic point of view this may be a merit rather than a defect, for it will furnish opportunity for a presentation by the students of the court's reasoning as gained by a reading of the cases, and a criticism by the instructor of the reasoning as thus pre sented. Book excerpt: Excerpt from Political and Constitutional Law of the United States of America The principles fundamental to political self-government, should doubtless be clearly understood by every vo'rnn or macros. For his status, in this country, is no less than that of one of a body of absolute sovereigns.l The three fundamentally different and mu tually opposing theories of our political system, - one or another of which every voter must necessarily sanction, and consequently, -one or another of which must furnish the key to every administra tion of government, state and federal, - are therefore severally and distinctly presented, so that every voter may judge for himself, as he ought to do, which of these theories should receive his assent and support. Attention is also directed to the different foundations of govern ment, to the rise and development of the system peculiar to Amer ica, to the sovereign legislation by the People themselves from the dawn of the Revolution to the xvth Amendment, and to the views and doctrines of the original framers of our Constitutions; ever so little reflection upon which will enable any voter to form his own independent opinion, regardless of partisan strifes, and to cast his vote with a clear understanding of what it involves. Book Studies in Constitutional Law

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Studies in Constitutional Law: France, England, United States In introducing the book in an English form to readers unable to enjoy the French original, I can confidently recommend it to the attention of students. The work was originally composed for Frenchmen; hence the author occasionally insists upon features in the English Constitution which to Englishmen may appear to be too well known to require notice or explanation. But the fact that the essay is written by a foreigner for foreigners, though it may seem at first sight to limit the utility of the book for: English students, is in reality one of its great recommendations. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Constitutional Law: Being a Collection of Points Arising Upon the Constitution and Jurisprudence of the United States Which Have Been Settled by Judicial Decision and Practice Tue author of the following treatise believes its object and plan to be novel. He has met with no work, whence he could derive assistance. He does not doubt, that many imperfections may be found in it, which he has himself been unable to detect or remedy. The learned and candid reader will appre ciate the difficulties attending the undertaking, and make every reasonable allowance. Every American lawyer must feel the utility of re ducing to system, the principles and practice of our National Jurisprudence, of tracing them up to their constitutional source, and of exhibiting, in a succinct manner, the general origin, and uniform harmony, of the whole. If the writer has succeeded in laying the foundation for a work of this kind, he will be satisfied; leaving to more competent hands, the completion of a task, which must greatly aid in the diffusion of knowledge, on subjects of the highest importance, and most extensive application. Book Constitutional Law

Download or read book Constitutional Law written by H. J. Fenton and published by . This book was released on 2016-06-16 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Constitutional Law: An Introductory Treatise Designed for Use in the United States Naval Academy, and in Other Schools Where the Principles of the Constitution Are Studied Scope. - This book is introductory in scope. It is a study of the text of the Constitution and the principles of law pertaining to it, designed mainly for those students who are just beginning their inquiry into the subject of law and government. By it it is hoped that the student may obtain such knowledge of the instrument of government under which this country has lived for more than a century as is almost requisite for a liberal education and for good citizenship; and that those who have the time and the inclination to pursue the subject further may be inspired to do so. Sources. - Except perhaps in the use of cases and in certain minor details this book pretends to no originality. It is the business of the law writer, like the historian, to record rather than to make. It is partly from classroom notes, the product of ten years in the teacher's chair; partly from the writings of such excellent publishers as Story, Black, Cooley, McLain, Pomeroy, Wilson, Baldwin and Burgess; and partly from a wide reading among the cases decided by the Supreme Court that this book is compiled. Cases. - Since American Constitutional Law is largely a child of the Supreme Court the writer has made frequent use of cases for illustrative purposes, and has besides referred to many others in footnotes. Furthermore, an abstract of the leading and most interesting Supreme Court cases is printed in Chapter IX, which, it is hoped, will be found interesting and useful, both to instructor and to student. Book Cases on American Constitutional Law Classic Reprint

Download or read book Cases on American Constitutional Law Classic Reprint written by Carl Evans Boyd and published by Forgotten Books. This book was released on 2017-10-15 with total page 696 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on American Constitutional Law In making this collection of cases, it was not my purpose to at tempt to rival the notable collection of Professor Thayer. I have had the more modest design of bringing together within the com pass of a single volume a sufficient number of the leading decisions of the Supreme Court of the United States on constitutional law to form the basis of a university course in that subject. The se-called case system of study is applied to almost all branches of the law, but its application to constitutional law has been retarded by the obvious impracticability of referring a class to the original reports and by the want of a suitable case book of moderate size. It is to meet sncli requirements that this collection has been formed. A work of this kind is necessarily a compromise between the de sirable and the attainable. The exigencies of space have compelled me to exclude numerous instructive decisions which many persons may expect to find and which I would have been glad to print. For the further economy of space, arguments have been omitted and the notes are few. It seemed that the pages required for these features could be more profitably devoted to decisions which must otherwise be excluded. This book was released on 2017-11-06 with total page 746 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Rules Which Govern the Interpretation and Construction of Statutory and Constitutional Law The treatise upon the Interpretation and Application of Stat utery and Constitutional Law, like that upon the Measure of°dam ages by the same author, has been, from the date of its publication, regarded as a legal classic. Based, in the main, ' upon the decisions of American courts, and discussing the principles of statutory con struction as they have been expounded and illustrated by those tribunals, it has been far more useful to the American lawyer, and has been more readily accepted as a guide and helper by American judges, than any work upon the same subject founded chiefly upon English precedents and drawing its materials from English sources. Originally published in the year 1857, the first impression was long ago exhausted, and a new edition has long been demanded. This want is now supplied, and a new edition is offered to the profession. It is proper for the editor to explain its plan, and the nature and scope of the additions which he has made.
