Book excerpt: Situated within the context of the ongoing debate about European contract law, this book provides a detailed examination of the European Union's competence in the field of contract law. It analyses the limits of Union competence in relation to several relevant Treaty provisions which potentially confer competence on the Union to adopt a comprehensive contract law instrument and the exercise of Union competence in connection with the operation of the principles of subsidiarity, proportionality and sincere cooperation. It also explores the viability of several alternative and complementary routes to the adoption of such an instrument, including enhanced cooperation, an intergovernmental treaty and certain American techniques. Setting forth an elaborate account of the context for this debate and its chronological development at the European level, this book charts the discussions relating to the European Union's competence to regulate contract law and offers a comparative analysis of the approach taken to the approximation of contract law in the American setting. Setting forth a detailed account of the context for this debate and its chronological development at the European level, the book charts the discussions that have occurred within and outside the EU relating to the transnational competence to regulate contract law. Situating European constitutional law within the continued debate about European contract law, it also reflects upon the contract law structure of the United States and examines the viability of alternative and complementary routes to the adoption of a comprehensive instrument of substantive contract law.

Book excerpt: Launched in March 2010 by the European Commission, the Europe 2020 strategy aims to achieve "smart, sustainable, and inclusive" growth. The engines for this growth are - Knowledge and innovation - Greener and more efficient use of resources - Higher employment combined with social and territorial cohesion This CEPS report takes an in-depth look at this major initiative and finds that the strategy itself needs to be revised in several important respects. First, the authors believe, R&D spending per se is not the best indicator of innovativeness; a new measure, intangible capital, would be more appropriate. Second, while increasing the share of the workforce with a university degree is important for competitiveness and employment, it is the quality of that education that matters more than the quantity. The study also finds that employment targets would be better reached by a skills upgrade among women who have the least education. Concerning climate change, the authors conclude that unless the EU increases the level of its ambition and adds a carbon import tariff, reduction targets for greenhouse gas emissions are likely to have a negligible impact on global climate change. Finally and more generally, the report argues that the 2020 strategy should acknowledge the importance of institutional efficiency at the national level.

With the expansion of the EU's powers into domains falling within the scope of the Area of Freedom, Security and Justice, liberty and its relation to security has brought a new range of issues, struggles and debates. Acts of political violence labelled as 'terrorism' and human mobility at the European and international levels have justified the construction of these phenomena as threats to the security and safety of the nation state. They have legitimised the development of normative responses that go beyond traditional configurations and raise fundamental dilemmas for the security and liberty of the individual. This paper assesses the ways in which the notions and perceptions of security and insecurity in the EU have evolved as political values and legal/policy goals, and how they are being transformed. It aims at synthesising the results of the research conducted since 2004 by the Justice and Home Affairs Section of CEPS through the CHALLENGE project (Changing Landscape of European Liberty and Security). The research has been premised upon one basic, but determining question: To what extent has the evolution of the international context altered the dynamics of liberty and security in the EU?
