The search for best practice and new models of contracting continues.Why, and how, has compulsory competitive tendering, imposed by local government, resulted in different policy outputs at the local level in Britain? This book provides a thorough investigation of the key determinants affecting the output of CCT, and addresses the dynamics of public service contracting via both the quantitative and the qualitative methods of analysis.The author shows the importance of the politics of transaction costs, in relation to the implementation of CCT policy. In doing so, he addresses theoretical questions which focus on specific aspects of privatisation.The investigation is centred on a study of 296 non-metropolitan districts in England. The detailed case studies then apply the politics of transaction costs framework to analyse how CCT output has been generated. The experience of four local authorities are compared to clarify the approach each local authority has taken in relation to CCT.The author concludes with suggestions for other countries seeking to introduce public service contracting, to assist them in implementing and managing the system more effectively.The dynamics of public service contracting is essential reading for students and practitioners of public administration, policy makers, policy analysts, and all those interested in the restructuring of the public sector.

Book excerpt: In the memorandum 'The role of major contractors in the delivery of public services' the NAO sets out some of the benefits that can be achieved through contracting but highlights three issues that deserve greater public scrutiny. First, it raises questions about the way public service markets operate. This includes the need for scrutiny over whether public service contracts are sufficiently competitive and whether the rise of a few major contractors is in the public interest. Secondly, it highlights the issue of whether contractors' profits reflect a fair return. Understanding contractors' profits is important to ensure that their interests are aligned properly with that of the taxpayer. But transparency over rewards that contractors make is at present limited. Thirdly, the report asks how we know that contractors are delivering services to the high standards expected. In particular, government needs to ensure that large companies with sprawling structures are not paying 'lip-service' to control and that they have the right culture and control environment across their group. This requires transparency over contractors' performance and the use of contractual entitlement to information, audit and inspection. This should be backed up by the threat of financial penalties and being barred from future competitions if things are found to be wrong. There is limited research that examines the role of contract management in the public sector. Furthermore, the available research concentrates on how public managers can determine whether conditions are appropriate for the use of contracting and not the interaction of public employees with contracting. The research also identifies the role that procurement plays in a successful acquisition of a contract but does not address the technical requirements necessary to implement and monitor a contract and service delivery. This research will seek to address the gap between how public employees affect contracting and how it translates to the overall implementation of a contract.

And this is particularly true in the matter of writing proposals, which are the crucial element in most major procurement awards. It's true enough, as many suspect, that the big, well-known company has something of an edge over the smaller, lesser-known company com peting for any given government contract-psychologically, at least: The typical government executives, whether contracting officials or program managers, tend to have a bit more faith in the ability of the large company to carry out the program successfully. All things being equal, then, the big company is more likely to get the nod. However, because the large companies are well aware of that, many tend to become "fat, dumb, and happy"-they try to coast or rest on their laurels. That is, they get careless about making a strong enough case for themselves in writing their proposals. And when they lose, often to smaller companies, they are both puzzled and outraged. They have for gotten that all government procurement is a competition-usually both technical and cost competition-and that the "little guy" can win against the "big guy," if he tries hard enough. And especially if the bigger guy is a bit careless and does not put out his best effort.
