Book The Disposition of Medical Malpractice Claims

Download or read book The Disposition of Medical Malpractice Claims written by Patricia Munch Danzon and published by RAND Corporation. This book was released on 1980 with total page 104 pages. Available in PDF, EPUB and Kindle. Book excerpt: A theoretical and empirical analysis of the disposition of malpractice claims compares the actual outcomes with the legal standard of payment equal to damages, if, and only if, negligence occurred. An economic model of the settlement process assumes that the litigants attempt to maximize wealth, subject to the legal standards of liability and damage, and the costs of litigating. The model predicts that awards in settlements out of court will reflect the expected verdict, the probability of the plaintiff's winning, and the costs of going to court. The probability of the plaintiff's winning in settlement will also reflect the probability of winning in court, the size of the expected verdict, and the costs of going to court. Evidence from three malpractice claims surveys is consistent with the legal standard but departs in ways predicted by the model. Characteristics of the injury, the plaintiff, and the defense influence the outcome.

Book Medical Malpractice Understanding The Law Managing The Risk

Download or read book Medical Malpractice Understanding The Law Managing The Risk written by Tan Siang-yong and published by World Scientific Publishing Company. This book was released on 2006-01-23 with total page 364 pages. Available in PDF, EPUB and Kindle. Book excerpt: This textbook is about the law of medical malpractice and how to prevent a malpractice lawsuit. It grew out of an earlier book covering medical negligence in Singapore. The book's primary goal is to provide a clear and simple explanation of the American law of medical malpractice, informed consent and risk management. Written with the clinician in mind, it is legally uncomplicated without being overly simplistic. The book is as much about medicine as it is about law; above all, it is about patients. It is written with the fervent belief that with better education, there will emerge a better appreciation of the expectations of the patient — often unmet — and the standards of the legal system — often misunderstood. Fewer lawsuits and improved patient care will hopefully follow. The book is in five sections. The first covers the law of malpractice and informed consent while the second covers risk management with chapters on confidentiality, communication and risk management tips. Section III is a single chapter on reforming the system, and discusses both medical and legal proposals. The subject of tort reforms is covered in this chapter. A review section consisting of 35 multiple choice questions and answers constitutes Section IV. The book concludes with a glossary of legal terms.

Book Medical Malpractice

Download or read book Medical Malpractice written by Patricia Munch Danzon and published by Harvard University Press. This book was released on 1985 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: How often are patients seriously injured through faulty medical care? And what proportion of these people receive compensation for their injuries and suffering? This is the first book that tries to answer these questions in a careful, scholarly way. Among its important findings is that at most one in ten patients injured through medical negligence receives compensation through the malpractice system. The focus of public attention has been on the rising cost to physicians of malpractice insurance. Although Patricia Danzon analyzes this question thoroughly, her view is much broader, encompassing the malpractice system itself--the legal process, the liability insurance markets, and the feedback to health care. As an economist, she is concerned with the efficiency or cost-effectiveness of the system from the point of view of its three social purposes: deterrence of medical negligence, compensation of injured patients, and the spreading of risk. To provide evidence of the operation of the system in practice, to distinguish fact from allegation, and to evaluate proposals for reform, she has undertaken a detailed empirical analysis of malpractice claims and insurance markets. It is a major contribution to our understanding of how the system works in practice and how it might be improved.

Available in PDF, EPUB and Kindle. Book excerpt: Books such as this one are deceptively difficult to create. The general subject is neither happy, nor easy, nor most anyone’s idea of fun. M- practice litigation, however, has become a central fact of existence in the practice of medicine today. This tsunami of lawsuits has led to a high volume of irreconcilable rhetoric and ultimately threatens the stability of the entire health care system. Our goal has been to provide a source of reliable information on a subject of importance to all who provide me- cal care in the United States. The book is divided into four sections. Part I gives an overview of insurance in general and discusses the organization of professional - ability insurance companies in particular. Part II focuses on the litigation process itself with views from the defense and plaintiff bar, and the physician as both expert and defendant. Part III looks at malpractice litigation from the viewpoint of the practicing physician. Some of the chapters are broadly relevant to all doctors—the rise of e-medicine, and the importance of effective communication, for example. The other ch- ters are constructed around individual medical specialties, but discuss issues that are of potential interest to all. Part IV looks ahead. “The Case for Legal Reform” presents changes in medical-legal jurisprudence that can be of immediate benefit. The final two chapters take a broader perspective on aspects of our entire health care system and its interface with law and public policy.

Book The Resolution of Medical Malpractice Claims Research Results and Policy Implications

Download or read book The Resolution of Medical Malpractice Claims Research Results and Policy Implications written by Patricia Munch Danzon and published by . This book was released on 1982 with total page 144 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the early 1970s, both the frequency of medical malpractice claims and the dollar awards to successful plaintiffs rose at unprecedented rates. In 1974-1975, the malpractice insurance crisis erupted. By the end of 1976, most state legislatures had enacted laws to deal with the perceived causes of the crisis. With only scant empirical evidence on the actual operation of the tort system and likely effects of any changes, however, legislators have had to rely on anecdote, subjective reasoning, and conventional wisdom. The research summarized in this report aims at rectifying that deficiency. It analyzes two computerized files on over 6,000 closed claims, using a computerized model of the bargaining behavior through which claims are resolved. It produced useful evidence on the actual operation of the malpractice system, including changes made during the crisis, and analytic tools that can be applied to understand dispute resolution in other contexts.

Book Abandoned Medical Malpractice Claims

Download or read book Abandoned Medical Malpractice Claims written by Dwight Golann and published by . This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Most medical malpractice claims are not won or lost in court, or settled. Instead, they disappear, abandoned by the plaintiffs who bring them. A study of 3,605 malpractice claims closed between 2006 and 2010 showed that in 46.4 percent of malpractice cases and 58.6 percent of claims against individual defendants, plaintiffs eventually dropped the case or claim without a decision or recovery. This did not occur, however, until defendants had incurred defense costs of more than $25,000 per claim and $44,000 per case and significant stress and other non-monetary costs were incurred by patients and doctors. The study included interviews of plaintiff lawyers, which show numerous reasons for plaintiffs' decisions to abandon a claim. The most common is that malpractice cases are complex and their validity is therefore difficult to ascertain before discovery processes occur. The article argues that patients and doctors have a joint interest in finding a better process, and notes that there are models for how this could be done. One hospital system which changed its approach to resolving potential malpractice claims found that the frequency and cost of cases declined by large percentages. The article suggests that plaintiff malpractice specialists, who accounted for a large proportion of the abandoned claims in the study, work with insurers and hospitals to develop ways to exchange information and discuss settlement efficiently. Such reforms would substantially reduce the frequency and duration of dropped claims and substantially reduce the cost of medical malpractice litigation, and could do so without impairing compensation to patients or their lawyers.
