The rapid developments have been closely interwoven with the economic, legal and institutional reforms that have taken place within the country in the larger scale, and deeply affected by the dynamic changes in the global realm of international taxation. Based on the examination of several key provisions under 29 tax treaties China signed and revisited since 2008, this research aims to offer answers to a set of questions such as: what are the differences between the BTTs that China signed with the developed countries and the developing countries? To what extent may the China's tax treaties network facilitate the outbound investment, particularly the “one-belt-one road” initiative? How will the signature of BEPS multilateral convention (2017) affect China's existing bilateral tax treaties?

Each chapter carefully analyses the extent to which Chinese tax treaties follow the OECD Model Tax Convention on Income and Capital and the UN Income and Capital Model Convention. The focus is on the different policy decisions underlying the various provisions. Additionally, the contributions analyse the extent to which Chinese tax treaty policy differs with respect to EU and non-EU Member States. They also highlight relevant policy changes over time. The fact that each contribution is the product of the collaboration between European and Chinese researchers and includes the results of the International Conference on Europe - China Tax Treaties Research, held in March 2009 in Beijing, serves to enrich its analysis. Book excerpt: The People’s Republic of China’s tax policies and international obligations are as multifaceted and dynamic as they are complex, developing closely with the nation’s rise to the world’s fastest-growing major economy. Today, after decades of reform and the entry into the World Trade Organization, China has developed regulatory systems that enable it to provide stable administration, including a tax structure. China’s main tax reform can be attributed to the enactment of the Enterprise Income Tax Law, which came into effect on January 1, 2008. Chinese tax regulations include direct taxes, indirect taxes, other taxes, and custom duties and from a collection point of view, China’s tax administration adopts a very devolved system, with revenue collected and shared between different levels of government in accordance with contracts between the different levels of the tax administration system. With respect to international treaties, China has established a network of bilateral tax treaties and regional free trade agreements. This publication describes in detail China’s complex tax system and policies, as well as major bilateral treaties in which China has entered into using country-by-country analysis. Lorenzo Riccardi is Tax Advisor and Certified Public Accountant specialized in international taxation. He is based in Shanghai, where he focuses on business and tax law, assisting foreign investments in East Asia. Book excerpt: The past 20 years have marked a movement in China's stance from being a net capital importer towards being a net capital exporter. In the process, it appears that its tax treaty policy on deductions allowed to permanent establishments has changed accordingly. While it was previously in China's interest to limit the deduction of expenses by permanent establishments to ensure that profit and tax was not extracted from China, the increase in China's investment in foreign economies has meant that it is now becoming favourable for China to enter into tax treaties which allow permanent establishments to deduct more expenses. This trend is demonstrated by Article 7.3 of China's tax treaties, which concerns the deductions allowed to permanent establishments. Article 7.3 of China's tax treaties takes one of three forms: being a replication of the OECD Model, a replication of the UN Model or an independent version. This article submits that as China moves from being a capital importing towards being a capital exporting country, its tax treaty approach has accordingly shifted from using Article 7.3 of the UN Model towards using Article 7.3 of the OECD Model.

With the switch to a quasi-market economy, China became reliant on taxes to fund government, opening the door to potential double taxation of profits from foreign investment, first in China and second in the investors' home countries. The issue was resolved in a series of tax treaties that divided taxing rights between China as a host country and the "residence" countries of the foreign investors. In many respects, China was able to extract generous concessions from the treaty partners, particularly OECD countries anxious to invest in China. Several decades later, the tables started to turn, with Chinese investment outbound climbing and eventually surpassing inward investment. Following renegotiation, several of the original treaties were replaced or revised. This article studies the extent to which China achieved a new division of taxing rights in its treaty network.
