Schrag, the director of Georgetown University’s asylum law clinic, takes readers through thirty years of conflict over which refugee advocates resisted the detention of migrant children. The saga began during the Reagan administration when 15-year-old Jenny Lisette Flores languished in a Los Angeles motel that the government had turned into a makeshift jail by draining the swimming pool, barring the windows, and surrounding the building with barbed wire. What became known as the Flores Settlement Agreement was still at issue years later, when the Trump administration resorted to the forced separation of families after the courts would not allow long-term jailing of the children. Schrag provides recommendations for the reform of a system that has brought anguish and trauma to thousands of parents and children. Book excerpt: This 'Briefing Paper' is in response to the US Immigration and Naturalization Service's 'South Texas detention policy' implemented in February, 1989. Beginning with the formalization of policies of detention in relation to the influx of Cubans and Haitians in 1981, the historical evolution of the policy is reviewed. Thereupon, the Paper addresses the present status of the policy and examines the conditions of detention, profiling those currently in detention, the various forms of their confinement, and considering the human, economic and policy-related effects. Legal analysis questions the foundations of detention policies and their implementation, including present technical distinctions concerning 'entry', 'excludable' and 'deportable' undocumented aliens, and 'arrival without valid travel documents'. Condemning the expansion of detention measures affecting asylum seekers in the US, specific conclusions are made and recommendations offered effecting administrative, judicial and legislative intervention and change, including: abolishing the detention of legitimate asylum seekers; ending the arbitrary 'South Texas detention policy' of automatic detention of asylum seekers; providing legal assistance for asylum seekers; providing resources assuring fair and expeditious adjudication; prohibiting the detention of minors in local jail facilities with standards promulgated by the American Correctional Association.
