The death penalty in Iran is familiar to most readers because capital punishment exists in the domestic law of most Islamic nations, but the ways by which these states employ capital punishment are varied and inconsistent. With the advent of Islamic fundamentalism in the 1970s, more and more Islamic states began objecting to international norms for human rights and abolition of the death penalty, as being contrary to sharia, the historically formulated traditional law of Islam.The question is why contemporary Islamic penal system of Iran is so cruel and short on mercy when in secular criminal justice systems efforts are made to guarantee that prisoners are treated humanely. This study reaches back to classical Islam and contemporary use of sharia law in Iran to trace how and why capital punishment in Iran is different from the United States.

Book excerpt: Between 2005 and 2015, Amnesty International recorded the execution of 73 juvenile offenders (people younger than 18 at the time of the crime), including at least four in 2015. A UN report issued in 2014 stated that more than 160 juvenile offenders were on death row. In 2013, Iran adopted a new Islamic Penal Code granting judges discretionary power to replace the death penalty with an alternative punishment if they find that a juvenile offender convicted of murder or certain other capital offences did not understand the nature of the crime or its consequences or there are doubts about his or her "mental maturity and development". Hopes were reinforced by a 2014 decision from Iran's Supreme Court that all juvenile offenders on death row could seek retrial. However, over the past two years the authorities have continued to carry out executions of juvenile offenders, failing to inform them of their right to file an "application for retrial". Also worryingly, several juvenile offenders who had been granted a retrial have been resentenced to death. These cases highlight, yet again, the urgent need for Iran to comply with its international obligations by abolishing completely the use of the death penalty against juvenile offenders.

Less known to outside observers, however, is the Iranian criminal code’s recognition of forgiveness, where victims of violent crimes, or the families of murder victims, can request the state to forgo punishing the criminal. Forgiveness Work shows that in the Iranian justice system, forbearance is as much a right of victims as retribution. Drawing on extended interviews and first-hand observations of more than eighty murder trials, Arzoo Osanloo explores why some families of victims forgive perpetrators and how a wide array of individuals contribute to the fraught business of negotiating reconciliation. Based on Qur’anic principles, Iran’s criminal codes encourage mercy and compel judicial officials to help parties reach a settlement. As no formal regulations exist to guide those involved, an informal cottage industry has grown around forgiveness advocacy. Interested parties—including attorneys, judges, social workers, the families of victims and perpetrators, and even performing artists—intervene in cases, drawing from such sources as scripture, ritual, and art to stir feelings of forgiveness.
