Book EU Cross Border Commercial Mediation

Download or read book EU Cross Border Commercial Mediation written by Anna Howard and published by Kluwer Law International B.V.. This book was released on 2021-01-13 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite the growing national and international regulatory framework to support cross-border mediation, the use of such mediation appears to remain stubbornly low. This book focuses in particular on the European Union’s (EU’s) continued efforts to encourage the use of cross-border mediation and examines why such efforts have had a limited impact. It does so by drawing on rare, and at times surprising, detailed insights from in-house counsel of multinational companies regarding their use of EU cross-border commercial mediation. By viewing mediation through the lens of disputants, new and important findings regarding why disputants do, and do not, use cross-border mediation have emerged. While these findings are of primary relevance to EU policy and practice, they have implications far beyond the EU context at a time of increasing international interest in cross-border mediation. The analysis of the insights provided by the disputants reveals, for example: the prominent role played by negotiation as a cross-border dispute resolution process; that negotiation is a key comparator for disputants when considering whether to use mediation; how the EU’s continued focus on understanding and presenting mediation as an alternative to litigation has resulted in measures which are insufficient to address fully the barriers to the use of mediation; intriguing barriers to the use of mediation which arise from the association which disputants draw between mediation and negotiation; how the relationship which disputants draw between mediation and negotiation paradoxically raises both opportunities for, and obstacles to, the increased use of mediation; and what disputants need in order to increase their use of cross-border mediation. The qualitative nature (by way of interviews) of the research conducted for this book has enabled the identification of nuanced and novel findings regarding mediation’s position and potential in cross-border dispute resolution. These findings, together with a detailed examination of the EU Directive on Certain Aspects of Mediation in Civil and Commercial Matters and the EU’s continued initiatives to foster the use of mediation, form the foundation upon which this book’s recommendations are built. Changing the frame to view the use of mediation through the disputants’ perspective, as this book does, provides the opportunity for the EU to promote cross-border mediation in a way which resonates more deeply with disputants and responds more fully to their concerns and needs. This thought-provoking book will be of interest not only to European and national bodies seeking to promote the use of mediation but clearly also to dispute resolution academics, in-house counsel, and of course mediators and dispute resolution practitioners in general.

Book Insurance Distribution Directive

Download or read book Insurance Distribution Directive written by Pierpaolo Marano and published by Springer Nature. This book was released on 2021 with total page 439 pages. Available in PDF, EPUB and Kindle. Book excerpt: This open access volume of the AIDA Europe Research Series on Insurance Law and Regulation offers the first comprehensive legal and regulatory analysis of the Insurance Distribution Directive (IDD). The IDD came into force on 1 October 2018 and regulates the distribution of insurance products in the EU. The book examines the main changes accompanying the IDD and analyses its impact on insurance distributors, i.e., insurance intermediaries and insurance undertakings, as well as the market. Drawing on interrelations between the rules of the Directive and other fields that are relevant to the distribution of insurance products, it explores various topics related to the interpretation of the IDD - e.g. the harmonization achieved under it; its role as a benchmark for national legislators; and its interplay with other regulations and sciences - while also providing an empirical analysis of the standardised pre-contractual information document. Accordingly, the book offers a wealth of valuable insights for academics, regulators, practitioners and students who are interested in issues concerning insurance distribution.--

Book Brexit and the Digital Single Market

Download or read book Brexit and the Digital Single Market written by Alison Harcourt and published by Oxford University Press. This book was released on 2023-07-02 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Digital Single Market (DSM) 2014-19 was the largest component of the European Union's Single Market programme, comprising numerous Directives, Regulations, and instruments aimed at facilitating cross-border digital services. With one-fifth of service exports stemming from the digital sector, the DSM was vital for the UK, with the EU representing its largest export market. Brexit and the Digital Single Market examines the important historical role of the UK in DSM development, the consequences of Brexit for the UK's digital sector, and future EU and UK policy trajectories. Assessing both vertical sectors and horizontal policies, this book demonstrates how the UK acted as a policy entrepreneur in pushing for a deregulatory framework by exploiting temporal events historically. The current challenges presented by Brexit are discussed in detail, closely observing topics such as the loss of the country of origin principle and freedom of movement, changes to copyright and VAT regimes, complications with cross-border data transfer, administrative procedures, and international taxes on digital products and services. Brexit and the Digital Single Market illuminates how the UK continues to innovate in the digital sector but is constrained by external factors both at EU and global levels. It also considers how EU policy is taking a new direction in its 2020 Digital Strategy programme, which leans towards greater protection of European champions and digital sovereignty, a tightening of its data protection regime, and greater regulatory intervention in digital markets. Timely and unprecedented, Brexit and the Digital Single Market is the first volume to comprehensively cover the implications of Brexit for the EU's DSM. This is an essential read for students and academics in political science and law and those from the civil service and government working within the digital sector.

Book Residential Construction Law

  • Author : Philip Britton
  • Publisher : Bloomsbury Publishing
  • Release : 2021-07-15
  • ISBN : 1509939245
  • Pages : 743 pages

Download or read book Residential Construction Law written by Philip Britton and published by Bloomsbury Publishing. This book was released on 2021-07-15 with total page 743 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to offer a systematic and analytical overview of the legal framework for residential construction. In doing so, the book addresses two fundamental questions: Prevention: What assurances can the law give buyers (and later owners and occupiers) of homes that construction work – from building of a complete home to adding an extension or replacing a shower unit – will comply with minimum standards of design, safety and build quality? Cure: What forms of redress - from whom, and by what route - can residents expect, when, often long after completion of construction, they discover defects? The resulting problems pose some big and difficult questions of principle and policy about standards, rights and remedies, which in turn concern justice more generally. This book addresses these key issues in a comparative context across the United Kingdom, Ireland, Australia and New Zealand. It is an accessible guide to the existing law for residents and construction professionals (and their legal advisers), but also charts a course to further, meaningful reforms of the legal landscape for residential construction around the world. The book's two co-authors, Philip Britton and Matthew Bell, have taught in the field in the UK, Australia and New Zealand; both have been active in legal practice, as have the book's two specialist contributors, Deirdre Ní Fhloinn and Kim Vernau.
