Book excerpt: How was it that the Torrens system, a mid-nineteenth-century reform of land titles registration from distant South Australia, gradually replaced the inherited Anglo-Canadian common law system of land registration? In The Law of the Land, Greg Taylor traces the spread of the Torrens system, from its arrival in the far-flung outpost of 1860s Victoria, British Columbia, right up to twenty-first century Ontario. Examining the peculiarity of how this system of land reform swept through some provinces like wildfire, and yet still remains completely unknown in three provinces, Taylor shows how the different histories of various regions in Canada continue to shape the law in the present day. Presenting a concise and illuminating history of land reform, he also demonstrates the power of lobbying, by examining the influence of both moneylenders and lawyers who were the first to introduce the Torrens system to Canada east of the Rockies. An exact and fluent legal history of regional law reforms, The Law of the Land is a fascinating examination of commonwealth influence, and ongoing regional differences in Canada.

Book excerpt: This thesis examines the destruction of the Torrens River as a natural river ecology and its recreation as an artificial one. The fragile watercourse was transformed in the nineteenth century into an artificial lake on a European scale. The author presents the reasons behind the changes which took place, covering both physical changes and society's altering conceptions of the river. The period of study ranges from the Kaurna people's life, which adapted around the river they called Karrawirraparri, to the damming of the river in 1881.

TAYLOR OF QLENWOOD SPRINGS, COLORADO. THE TORRENS SYSTEM OF REGISTERING TITLE TO LAND. HISTORICAL. Mr. President and Gentlemen of the Colorado Bar Association: The evolution of the manner in which the various tribes and nations of the earth have held the lands they occupied forms many interesting chapters in the history of the human race. From the Bible we learn that in the beginning man depended for his sustenance upon his prowess in the chase, supplemented by a desultory and intermittent cultivation of the soil. He was nomadic in his habits and cared little for the use of land for other than his temporary convenience. There is little doubt but that for centuries there was no such thing as individual ownership of any particular plot or portion of ground. During all of that period man was contented with bare or naked possession, and neither sought for nor desired a better title. As the family circle widened, and the tribes were formed, the more desirable locations were selected and cleared, and the value of these possessory rights became more apparent. The head of the household or chief of the tribe was looked upon as the owner of the ground upon which the family or community was settled, and assumed the authority of apportioning or alloting to each householder some particular portion of the land occupied. The pasture or range of land, as we would call it, as well as the wild country beyond the domains of the community, were looked upon as the common property of all. Considering the nature and habits of the people, it was but a step from this system to the feudal system of tenureship. Possession was the title to real estate. Conveyance was made by open and notorious delivery of the possession. Afterwards witnesses...

The first part provides the social and political contexts for legal history in medieval and early modern England and America, explaining the English law which came to Australia in 1788. This includes: The origins of the common law The growth of the legal profession The making of the Magna Carta The English Civil Wars The Bill of Rights The American War of Independence. The second part examines the development of the law in Australia to the present day, including: The English criminal justice system and convict transportation The role of the Privy Council in 19th century Indigenous Australia in the colonial period The federation movement Constitutional Independence The 1967 Australian referendum and the land rights movement.
