The collection of documents contained in this volume is an attempt to rectify this situation. A unique reference tool to those with an interest in human rights in Asia and the Pacific, be they students of law, Asian studies or international relations, or lawyers or researchers using human rights materials, this volume contains various inter-governmental and non-governmental documents, as well as a section on numerous human rights organisations and resources. Despite the Asia-Pacific area now being the world's only region without a human rights instrument, the volume of constitutional provisions, treaty provisions, governmental and non-governmental declarations on human rights as well as other types of relevant documents is very substantial, putting to lie the argument that human rights are of little concern or secondary to other considerations. This huge amount of material has made it necessary to edit certain documents to their most essential elements. Other documents are included in their entirety where they are deemed to be of particular significance.

Book excerpt: In Participation, Power and Attitudes: Implementing Article 12 of the Convention on the Rights of the Child, Rebecca Thorburn Stern analyses how CRC state parties describe their implementation of Article 12 on respect for the child’s views. The focus of the study is on if, and how, references to traditional attitudes are used by state parties to explain their actions and inactions when implementing this key right and principle. It is shown that 'traditional attitudes' are employed less as justification of poor implementation than as a way of allocating responsibility to the population rather than to the state party, and that references to tradition remain a mainly non-Western phenomenon, thus also overlooking the impact of traditional attitudes in Western societies.

The urgency for states in Africa to implement climate interventions while they face developmental challenges, however, raises questions of ‘justice’ or ‘fairness’ between the developed and the developing states. Consequently, interrogating how the human rights paradigm may respond to negative implications of climate change and its ‘fairness’ is important as states continue to engage with the climate change standard setting. This edited volume critically interrogates human rights paradigm as an intervention to secure climate change justice for vulnerable populations; analyses regional protection against human rights consequences of climate change; and assesses emerging interventions based on domestic regulatory frameworks on climate change in selected states in Africa.
