Book excerpt: Excerpt from The Convention of 1846 In the first volume of the series devoted to Wisconsin consti tutional beginnings the popular discussion and o Icial proceed ings attendant upon the movement for statehood in 1845 - 46 were presented. The present volume deals with the first con stitutional convention, held at Madison in the autumn of 1846. In the laborious sessions of this body the ideas with respect to a framework of government for the commonwealth about to come into being were reduced to tangible form. That the mem bers of the convention performed their work in a spirit of sober earnestness will be questioned by none conversant with their proceedings. Nor will anyone question that the people of the territory were aware of their dependent political status and overwhelmingly desirous of entering upon statehood. Yet the convention's labors had a curious and for the time being a dis appointing issue. Notwithstanding the electorate was pre dominantly Democratic and the Whig membership in the con vention was small to the point of insignificance, the electorate repudiated the handiwork of its representatives by a decisive majority. The reasons for this are set forth in the historical introduction at the opening of the preceding volume. They find abundant illustration in the pages of the present volume. Admitted to the Union in 1848, and most notable of all the states, perhaps, for its development in recent years of progressive political policies and machinery, Wisconsin still keeps its original constitution. Although seventy years is not commonly regarded as a long period in the lives of nations, from the relative point of view the constitution of Wisconsin is hoary with age. Looking abroad it is older - to mention only a few instances - than the present governments of Russia, Germany, France, Italy, Austria-Hungary, Turkey, Bulgaria, Roumania, Servia, Portugal, China, Japan, Australia, Canada, Mexico, and, of course, of most of the countries of Africa and South America. At home, although by no means the oldest of existing state constitutions, that of Wisconsin is the oldest of any state west of the Allegheny Mountains. The constitution of Alabama dates from 1901, and is the fourth organic framework of government to be adopted in the last forty-three years. That of Mississippi was adopted in 1890 and the state has had four in a hundred years. Tennessee's constitution, the third in her history, dates from June, 1870. Kentucky's present constitution, the state's fourth, was adopted in 1891. Arkansas has had three since 1864, her present one having been adopted in 1874. Missouri's constitution dates from 1875 and is the third one adopted by the state in less than a century. Illinois closely resembles Missouri; her present constitution is her third one and was adopted in 1870. Iowa was admitted to the Union in 1846, two years before Wisconsin, and her first constitution lasted but eleven years. In the introductory chapter I have attempted to trace, briefly, and in a very general way, the extension of American influence over the territory from an early date to the completion of the conquest. This is followed by a more detailed account of the period of military rule and the political unrest resulting therefrom. The work of the Convention of 1849 and the election, organization, and important enactments of the first Legislature have been given due consideration. Chapter eighteen deals with the admission of California into the Union, and in the final chapter will be found some statistics on the population and resources of the new state in 1850. The general impression that a group of southern politicians dominated the Convention of 1849 is contrary to fact as may be seen. The extensive eastern boundary was not supported by southern men any more than by northern, and the exclusion of the free negro was a question in which the man from the northern states was interested as much as the man from the South. The State Legislature, however, did finally send two proslavery men to represent California in the Senate of the United States. Book excerpt: Excerpt from Constitutions and Constitutional Conventions in Missouri Missouri has had five Constitutional Conventions but only three Constitutions have existed in the history of the State. The first of these was adopted by the Convention of 1820 and continued to operate until 1865. In 1845 a Constitutional Convention submitted a Constitution which was rejected by the voters. In 1861 a Convention was called for the primary purpose of determining the attitude of Missouri regarding the Union. After deciding by a practically unanimous vote against secession, the Convention adjourned instead of disbanding. It held four other sessions during 1861 and the two succeeding years and practically carried on a provisional government. While it adopted a number of constitutional amendments, the Convention did not undertake to make any general revision of the fundamental law of the State. In 1864 the voters approved the plan of calling a Constitutional Convention, which met in 1865 and drafted a Constitution which was adopted by the voters. This Constitution remained in effect until it was superseded by the present Constitution which was adopted in 1875. While this article is primarily concerned with the Constitutional Convention of 1875 and the conditions which influenced its action, it will be desirable to consider briefly the preceding Constitutional Conventions which drafted Constitutions and to point out some of the more important features of these instruments.
