Purchasers can usually download a free scanned copy of the original book (without typos) from the publisher. Not indexed. Not illustrated. 1860 edition. Therefore a person incurs an obligation who has subjected himself to another (1) by contract, or (2) by wrong, or (3) by other circumstances facta), which, though neither contracts nor wrongs, produced, by special provision of law, effects like those produced by contracts or wrongs. "Obligationes aut ex contractu nascuntur, aut ex maleficio, aut proprio quodam jure, ex variis causarum figuris." Justinian does not say, " ex quasi contractu; ex quasi delicto;" but "quasi ex contractu; quasi ex delicto." That is, they exist as if there had been a contract or a delict, though there was none. The results of the facta resemble those of a contract or wrong; but the facta themselves remain facta still. Now, the man who incurs an obligation in any of these ways ought to be made to answer to every action which the obligation gives rise to, before the Judge of the territory where he entered into or made it. As to jurisdiction arising from contracts, and citation in loco Jurisdiction in contractus, the rule has never been more clearly stated than mratuT' the following words: --" Neque vero statutum, aut consuetudo loci, solos cives, et homines suburbiorum, veluti subditos statuentium comprehendit; verum etiam forenses ac extraneos, dummodo hoc posteriore casu duo interveniant cumulative...

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A History of Divorce So far as I am aware, there is no book in the English language which gives a concise and simple account of the history of divorce, and there is no modem problem in which the historical and comparative study of law and opinion is so essential for those who administer or make the laws, and all those who wish to have an adequate knowledge of the subject in its modem bearings. The extraordinary diversity of laws and opinions which exists in modem countries of the same degree of civilisation, often professing the same religion, when seen in the light of history is found to have certain common elements which show that substantially the same forces have been at work in their evolution. The object of this book is to explain, as briefly and simply as I can, how this diversity came about, to endeavour to deduce from the facts of history the tendencies of thought and legislation, and to ascertain the principles which, according to the teaching of history, ought to be applied to modern legislation on the subject. Book A Popular Treatise on the Law of Marriage and Divorce Classic Reprint

Download or read book A Popular Treatise on the Law of Marriage and Divorce Classic Reprint written by Marvin S. Robinson and published by Forgotten Books. This book was released on 2018-01-02 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Popular Treatise on the Law of Marriage and Divorce To those who have patronized these divorce sharks, and to those who may be tempted so to do, this little book is dedicated. A careful peru sal of its contents may enable them to protect themselves against fraud, and possibly save some of them from the penitentiary. There is but one road over which one must travel to undo a marriage, and this is through the channels of the local courts, where one, at least, of the parties permanently resides and has his or her domicile. A divorce obtained otherwise, though red-taped, red-lined, and bearing a golden seal, is but as waste paper, and no protection whatever at any time or place. Book Marriage and Divorce Laws of the World Classic Reprint

Download or read book Marriage and Divorce Laws of the World Classic Reprint written by Hyacinthe Ringrose and published by Forgotten Books. This book was released on 2017-09-16 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Marriage and Divorce Laws of the World The purpose of this volume is to furnish to the lawyer, legislator, sociologist and student a working summary of the marriage and divorce laws of the principal countries of the world. There are no geographical boundaries to virtue, wisdom and justice, and no country has as yet monopolized all that is best in creation. The mightiest of the nations lacks something which is possessed by the weakest; and there is no branch of comparative jurisprudence of more general con sequence than that treating of marriage, which is the keystone of civilization. By civilization we do not mean community life according to the standard of a single individual or nation, but in its broader and better sense, meaning the civil organization of any large group of human beings. Book excerpt: Excerpt from A Summary of the Law of Divorce During the past winter a series of lectures upon legal topics was delivered by myself and others to the members of the Junior Bar and Law Students. One of these lectures by me was on the subject of Divorce. The lecture was prepared without any thought of its subsequent publication in any more enduring form than typewritten sheets. Those by whom the lectures were arranged, however, ex pressed a desire to have it printed and I have assent ed to that being done. A summary of such of the Imperial Statutes, 1857 to 1870, relating to Divorce and Matrimonial Causes, as are in force in the four Western Provinces (omitting only such sections as are manifestly in applicable) is printed as an appendix. Book excerpt: Excerpt from The French Law of Marriage, Marriage Contracts, and Divorce, and the Conflict of Laws Arising Therefrom IN no respect does the spirit Of French law differ more radically from that Of our own than in relation to marriage. SO great indeed is the divergence that a Widespread knowledge Of it is desirable in View Of the frequency Of intermarriage between citizens Of the two countries, and the irremediable evils which a very excusable ignorance on the subject is likely to occasion. The intention of this Work is to explain so much of the French Law Of Marriage and the property relations resulting therefrom as is necessary in order to bring into relief the points upon Which that law differs from our own; and although this aim cannot be attained Without a more or less systematic exposition Of the French law, an exhaustive treatment Of the subject in all its details Will not be attempted.
