Excerpt: ... the time of the last call for twelve regiments, concurring in this view, and recognizing this right of the State. And it is proper that I should remark that the State has, in each case, been permitted to exercise this right, when the troops entered the service in compliance with a requisition upon the State for "organized bodies of troops." The right does not stop here, however. The Constitution does not say the State shall appoint the officers while the organizations may be forming to enter the service of the Confederacy but while they "may be employed in the service of the Confederate States." Many thousands are now so employed. Vacancies in the different offices are frequently occurring by death, resignation, etc. The laws of this State provide how these vacancies are to be filled and it is not to be done by promotion of the officer next in rank, except in a single instance, but by election of the regiment, and commission by the Governor. The right of the State to appoint these officers seems to be admitted, and is, indeed, too clear to be questioned. The Conscription Act, if it is to be construed according to its language, and the practice which your Generals are establishing under it, denies to the State the exercise of this right, and prescribes a rule for selecting all officers in future, unknown to the laws of Georgia, and confers upon the President the power to commission them. Can this usurpation (I think no milder term expresses it faithfully) be justified under the clause in the Constitution which gives Congress power to "raise armies?" and is this part of the Act constitutional? Brown on Federal Relations, transmitted to the General Assembly on the 7th of November, 1860; resolutions of the people of various counties on the same subject, sent to the Legislature; the address of Thomas R. R. Cobb, before the Legislature, in favor of the immediate secession of the State from the Union, and that of Alexander H. Stephens, before the same body, opposing it Mr. Cobb, in righteous indignation, recounted, in burning words, the provocations which not only justified but demanded the immediate secession of the State, while Mr. Stephens, admitting the right of the State to annul the original compact and withdraw from the Union, and the sufficiency of the provocation to justify the adoption of such a course, looked more to the end than to the provoking causes, and foresaw with prophetic ken the woes which would follow Civil War, which he regarded as inevitable should the Union be destroyed. These two addresses, emanating from the brains of two of Georgia's most able and illustrious sons, are inserted that posterity may be fully informed as to the grounds on which both those who favored and those who opposed the immediate withdrawal of the State from the Federal Union based their actions. Book excerpt: Excerpt from The Confederate Records of the State of Georgia, Vol. 4: Compiled and Published Under Authority of the Legislature Upon the surrender of the Confederate armies under Generals Lee and Joseph E. Johnston, the President, Andrew Johnson, following the precedent established by President Lincoln in Tennessee, Arkansas and Louisiana, proceeded to reconstruct the government of the State of Georgia. He first issued a proclamation appointing James Johnson, of Georgia, Provisional Governor, and in this proclamation he prescribed the duties of the Provisional Governor and gave him instructions as to how he should proceed. Provisional Governor Johnson, in accordance with these instructions, issued a proclamation ordering an election for delegates to a convention of the people of the State whose duty would be to revise the Constitution or adopt a new Constitution preparatory to the re-admission of the State into the Federal Union. In the President's proclamation appointing Mr. Johnson he had prescribed the qualifications of voters in the election of these delegates. Provisional Governor Johnson faithfully carried out the instructions of the President, ordering an election at which delegates to the proposed convention were elected, and the convention adopted a Constitution which was approved by the President of the United States and ratified by the qualified voters of the State. Under the provisions of this Constitution an election was held for Governor and members of the Legislature.
