A duty of competence. How on earth can one act in the best interest of a client if one does not know how to achieve that best interest? Or worse, does not care enough to know? So competence is a character trait and a function of integrity. It is not that brokers choose to be incompetent. But they do choose to focus their attention elsewhere. Competence simply falls by the wayside. Unnoticed and unattended. There is an unwritten rule that we should not criticize our competitors. We all know this rule: It is unprofessional to badmouth our competitors. It serves no purpose and only makes us look small-minded. But in a book subtitled, Seeking Competence and Integrity in the Real Estate Business, it is important to point out that our purpose here is not to create a good professional impression, nor is it to demonstrate proper business comportment. Rather, the purpose of this book is to help you find and identify competence and integrity in an often murky field. Brokers have two primary jobs: Client Acquisition and Conveying Real Property. These two jobs involve entirely different skill sets. The type of person who is good at either one of these jobs is almost always not the type of person who is good at the other. Many very successful brokers are quite brilliant at client acquisition, but not terribly competent at conveying real property. To be successful in the real estate business, it is vital to have, or to generate, a stream of potential clients. In fact, this is so important that brokers will concentrate their time, effort, & money, on this aspect of the business to the detriment of all others. What you find is that the people who are most adept at this, do best in the business. And this does not go unnoticed by their colleagues. As a consequence, transactional competence suffers industry-wide. Why become a better negotiator when you can make more money prospecting? Why learn basic accounting, why keep up with contract & paperwork changes, the law, building techniques, technology, etc. The whole range of knowledge & expertise that is useful for serving clients. The customer service aspect of brokerage, the hands-on business of conveying real property, requires transactional competence. And most brokers just do not have it. Why? Because it is not important to them. The result is Greham's Law for Real Estate: The incompetent, low integrity brokers drive out the competent, high integrity brokers. Those brokers who focus on client acquisition drive out the brokers who focus on conveying real property. Of course, all brokers proclaim competence and integrity. Our goal is to determine what these qualities look like and how to find them. Such has been the case with regard to this volume. In 1984, the Center for Ethics, Medicine, and Public Issues held a conference with the title 'When are Competent Patients Incompetent?' with the support of the Texas Committee for the Humanities, a state-based program of the National Endowment for the Humanities. Assistance was provided by both Baylor College of Medicine and the Institute of Religion. This conference evoked a con siderable interest in examining further the moral status of competency determinations in the clinical setting. This interest is realized in this volume, which now affords us an opportunity to thank all those individ uals who made the conference possible, only some of whom are acknowledged in this Preface. In particular, we wish to express our gratitude to Baruch A. Brody, Rebecca Dresser, the Honorable Jerome Jones, H. Steven Moffic, Margery W. Shaw, Eleanor Tinsley, and Albert Van HeIden. The volume took its shape through the labors of Earl Shelp and Mary Ann Gardell Cutter, who inspired the further evolution of the papers presented at the conference and attracted contributions from individuals who had not attended. Book excerpt: This book examines the crisis at the famous insurance market, Lloyd's of London, during the late twentieth century, which nearly destroyed the 300-year-old institution. While rapid structural change resulting from system collapse is less common in insurance than in the history of other financial services, one exception was the Lloyd’s crisis. Hitherto, explanations of the crisis have focused on the effects of catastrophic losses and poor governance. By drawing on contemporary accounts of the crisis, the author constructs the first comprehensive scholarly analysis of the public and political response. The book applies theoretical concepts from behavioural economics and economic psychology to argue that multiple delusions of competence were at work both within and outside the Lloyd’s market. Arrogance, elitism and defence of vested interests comprised endogenous elements of the crisis. Entrenched ideas about the virtues of self-regulation and faith in insider experts also played a role. The result was a misdiagnosis by both insiders and politicians of what ailed Lloyd’s and a series of reforms that failed to address the underlying causes of its disease. This book offers a salutary lesson from recent history about the importance of the transparency, accountability and effective monitoring of financial institutions. It is of interest to academics and students of economic and financial history, business, insurance, political economy and history.
