Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The German Civil Code: Translated and Annotated, With an Historical Introduction and Appendices Nor is the German Code of more academic interest to the English-speaking peoples. Both England and America are closely connected with Germany - the former commercially, by its proximity to the Continent; the latter socially, by the great influx of German im migrants ia recent years. In this age of international intercourse, cases involving the conflict of laws come up from time to time, and it is not an uncommon thing for an English or American Court to be called upon to decide a question of German law. To place in the hands of English-speaking lawyers a reliable rendering of the Code is my object in undertaking this task. How far this object has been attained will depend upon the judgment of the profession. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book The Oxford Handbook of European Legal History

Download or read book The Oxford Handbook of European Legal History written by Heikki Pihlajamäki and published by Oxford University Press. This book was released on 2018-06-28 with total page 1217 pages. Available in PDF, EPUB and Kindle. Book excerpt: European law, including both civil law and common law, has gone through several major phases of expansion in the world. European legal history thus also is a history of legal transplants and cultural borrowings, which national legal histories as products of nineteenth-century historicism have until recently largely left unconsidered. The Handbook of European Legal History supplies its readers with an overview of the different phases of European legal history in the light of today's state-of-the-art research, by offering cutting-edge views on research questions currently emerging in international discussions. The Handbook takes a broad approach to its subject matter both nationally and systemically. Unlike traditional European legal histories, which tend to concentrate on "heartlands" of Europe (notably Italy and Germany), the Europe of the Handbook is more versatile and nuanced, taking into consideration the legal developments in Europe's geographical "fringes" such as Scandinavia and Eastern Europe. The Handbook covers all major time periods, from the ancient Greek law to the twenty-first century. Contributors include acknowledged leaders in the field as well as rising talents, representing a wide range of legal systems, methodologies, areas of expertise and research agendas.

Book The formation of legal unification in Germany in the 19th century

Download or read book The formation of legal unification in Germany in the 19th century written by Gökhan Kosak and published by GRIN Verlag. This book was released on 2014-03-11 with total page 27 pages. Available in PDF, EPUB and Kindle. Book excerpt: Seminar paper from the year 2013 in the subject Law - Philosophy, History and Sociology of Law, grade: 1,0, , course: Legal History, language: English, abstract: Thibaut and Savigny - this line up has been adopted in the historical books as one oft he most re- marquable and pathbreaking academical disputes in the history of Germany’s jurisprudence. These two highly respected and famous jurists fought about the necessity of a general civil law for the German Empire. Thibaut published his ideas on this matter of dispute in his pamphlet „On the necessity of a General Civil Law in Germany“ in 1814 on which Savigny responded in the very same year putting his outstanding argumentation against the need of a general civil law in his pamphlet „On the Vocation of our Age for Legislation and Jurisprudence". Such being the case will make it also necessary to review the proceedings in the deepness of the 19th century to be aware of the importance of the controversy for the legal development in Germany. Regarding the fact that a general civil code in Germany wasn’t published until 1900 Savigny might be seen as the winner of the dispute since he achieved to delay the unification for more than 80 years alt- hough the number of supporters on Thibaut’s opinion was noticeably larger. A more particular investigation on this shall follow later. The controversy was also the initial point for theories and doctrines that manifestly influenced the jurisprudence in the 19th century and in this way also the legislation of the private law codificati- on in Germany. On this occasion the following term paper will also enlighten the complex ideas of both sides under consideration of the relevant indicents in jurisprudence, history and the political situation of Germany in the 19th century. The author will then give a comprehensive overview of the progresses in the subsequent time of the controversy and resume the given information in a final judgement on the final realization of the German Civil Code.

Book The Commercial Code for the German Empire

Download or read book The Commercial Code for the German Empire written by Bernard A. Platt and published by Forgotten Books. This book was released on 2015-06-25 with total page 386 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Commercial Code for the German Empire The great advance made by the German Empire in the trade of the world during the last few years seems some reason for offering to such Englishmen as possess no knowledge of the German language, a translation of the Code by which that trade is regulated, and to whose rules and enactments it is subject. It is to the fact of our possessing the greatest share in the worlds trade that we, rightly or wrongly, ascribe our important position in it. For this reason alone the Commercial Code of any nation possessing one is of interest to us, more especially of one which, like the German Empire, is among our keenest rivals in the field of commerce, and is becoming every day more and more a manufacturing country.
