Book The Civil Code of Japan Classic Reprint

Download or read book The Civil Code of Japan Classic Reprint written by Ludwig Lonholm and published by . This book was released on 2015-07-13 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Civil Code of Japan The first draft of a Civil Code for Japan was drawn up by Mr. Boissonade de Fontarabie, a French jurist, and followed in the main the lines of the French law But shortly before it was to go into effect a committee of revision was appointed, who instead of simply revising that draft made a wholly new Code modeled very closely upon the new German Civil Code and entirely different from Mr. Boissonade's Code, which therefore never went into operation. The authors of the present thoroughly modern and scientific Code are Messrs. Nobushige Hozumi, Masakasa Tomii and Kenjiro Ume, professors of law in the Imperial University of Tokyo. The technical terms of the Civil Code are very often literal translations into Sinico-Japanese of the corresponding German words. This fact and the great difference in form, arrangement and terminology between the Japanese-German and the English law makes it often difficult to translate the Japanese words by proper technical equivalents in English. For the most part the same Japanese word has been translated whenever it occurs by the same English word, even at the cost of an occasional awkwardness of expression; but in a few cases it was impossible to follow this rule without impairing the clearness of the sentence. Now under Japanese law, the consignor might plead Art. 697 in favour of subsequent ratification, as his agent acted in his interest, but to admit that plea would give a very (Tangerous latitude to ratifications, and, but for the fact that it would be showing rogues the way, we might give an illustration in a fictitious case demonstrating how such latitude might be taken advantage of to perpetrate extensive frauds on merchants outside of the conspiracy, or on financial institutions. And the perpetrators of the fraud could not be touched. The absence of provisions dealing with the ratification of unauthorized acts by agents therefore is a most serious delect in the Civil Code which shows both carelessness and disregard of some of (ho elementary principles in Agency. Unlawful Profits. The desire of a considerable number of people in all countries is to make profits out of their dealings with others and leave them to find out whether those profits are lawful or not, and it will depend upon the nature of the transaction whether criminal or civil law must be appealed (o for redress. Criminal law will govern cases where criminal intent can be proved, whilst civil law will mostly deal will cases arising from ignorance or avarice. Art. 730 says: -- Any one who wil.hnut lawful reason has derived profits from the property or the services of another and has thereby caused him Iosr, must make restitution to the extent of his enrichment. The article makes il a condition Hint (lie perron out of whose property or services the unlawful profit has been made roust have suffered a loss. Book Contract Law in Japan

Download or read book Contract Law in Japan written by Hiroo Sono and published by . This book was released on 2019 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of the law of contracts in Japan covers every aspect of the subject - definition and classification of contracts, contractual liability, relation to the law of property, good faith, burden of proof, defects, penalty clauses, arbitration clauses, remedies in case of non-performance, damages, power of attorney, and much more. Lawyers who handle transnational contracts will appreciate the explanation of fundamental differences in terminology, application, and procedure from one legal system to another, as well as the international aspects of contract law. Throughout the book, the treatment emphasizes drafting considerations. An introduction in which contracts are defined and contrasted to torts, quasi-contracts, and property is followed by a discussion of the concepts of 'consideration' or 'cause' and other underlying principles of the formation of contract. Subsequent chapters cover the doctrines of 'relative effect', termination of contract, and remedies for non-performance. The second part of the book, recognizing the need to categorize an agreement as a specific contract in order to determine the rules which apply to it, describes the nature of agency, sale, lease, building contracts, and other types of contract. Facts are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Japan will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative contract law.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Civil Code of Japan, Vol. 2: With an Introduction Treating of the Japanese Family System, a Full Index to the Whole Code, and an Appendix Giving the Most Recent Legislation on the Subject In his able and exhaustive treatise on Japanese family law* Dr. Weipert has drawn attention to the importance of the Family in Japan. This importance is not derived from any idea of ancestry, though pride of birth is as common'as with us, but from another set of ideas, - from a difference in the point Of view from which society is regarded. It is due simply to the fact that the family is the social unit, and it is theoretically as great in plebeian as in patrician circles, for in this matter neither law, nor custom is any respecter of persons. With us it is the individual, in Japan it is the family, round which everything Centres. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
