Book The Civil Action for Sexual Battery

Download or read book The Civil Action for Sexual Battery written by Bruce Feldthusen and published by . This book was released on 2014 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: Increasingly, victims of rape, sexual exploitation, incest, and other child sexual abuse are seeking legal relief from the civil justice system. The plaintiffs in these sexual battery tort actions are almost always women, the majority of whom were battered when they were children. The defendants were always men, and men who knew their victims prior to the battery. Judgement has been given for the plaintiff in every case except one, but the defendants are frequently judgement-proof. It appears that personal, non-pecuniary goals account for as much or more sexual battery litigation than does the prospect of monetary damages. This article employs the emerging perspective of therapeutic jurisprudence to explore whether civil litigation might assist in the sexual battery victim's psychological recovery, as many such plaintiffs appear to expect it will. Section II outlines the potentially greater therapeutic benefits of tort compared to criminal prosecution. These derive mostly from the formal equality of tort law, and the relatively greater degree of victim control that it affords. These theoretical advantages are assessed with reference to what little relevant empirical and clinical literature exists. Section III considers more specifically the therapeutic implications of a civil suit deepening on whether it follows a criminal conviction, criminal acquittal, or no criminal action at all.The decided cases are too new, too few, and probably too unrepresentative, to support any firm conclusions about the therapeutic benefits of the sexual battery action. This article attempts instead to isolate specific issues for further consideration and empirical study. Research of that sort will enlighten us as much about tort law generally as about sexual battery in particular.

Available in PDF, EPUB and Kindle. Book excerpt: Sexual Assault in Canada is the first English-language book in almost two decades to assess the state of sexual assault law and legal practice in Canada. Gathering together feminist scholars, lawyers, activists and policy-makers, it presents a picture of the difficult issues that Canadian women face when reporting and prosecuting sexual violence. The volume addresses many themes including the systematic undermining of women who have been sexually assaulted, the experiences of marginalized women, and the role of women’s activism. It explores sexual assault in various contexts, including professional sports, the doctor–patient relationship, and residential schools. And it highlights the influence of certain players in the reporting and litigation of sexual violence, including health care providers, social workers, police, lawyers and judges. Sexual Assault in Canada provides both a multi-faceted assessment of the progress of feminist reforms to Canadian sexual assault law and practice, and articulates a myriad of new ideas, proposed changes to law, and inspired activist strategies. This book was created to celebrate the tenth anniversary of Jane Doe’s remarkable legal victory against the Toronto police for sex discrimination in the policing of rape and for negligence in failing to warn her of a serial rapist. The case made legal history and motivated a new generation of feminist activists. This book honours her pioneering work by reflecting on how law, legal practice and activism have evolved over the past decade and where feminist research and reform should lead in the years to come.

Available in PDF, EPUB and Kindle. Book excerpt: Fair adjudication of campus sexual assault is one of the most divisive issues facing the United States. Victims contend that schools aren't doing enough to protect them, and accused students complain that they are presumed guilty. Sexual Assault on Campus: Defending Due Process begins by critically assessing the extent of the problem, before explaining why the criminal justice system has been unable to respond adequately. The book discusses the Department of Education's attempts to force schools to take campus assault seriously and uses original data in assessing the fairness of adjudication in the wake of the 2011 'Dear Colleague Letter.' It also includes excerpts from interviews with complainants, accused students, and administrators, which offer readers a first-hand account of these proceedings. Finally, the book provides a critical, in-depth look at the Title IX regulations put in place by the Trump Administration, with detailed recommendations for how they can be improved.

Book excerpt: The first history--incisive, witty, fascinating--of the fight against sexual harassment, from the author of the New York Times bestseller Sisters in Law Linda Hirshman, acclaimed historian of social movements, delivers the sweeping story of the struggle leading up to #MeToo and beyond: from the first tales of workplace harassment percolating to the surface in the 1970s, to the Clinton/Lewinsky scandal--when liberal women largely forgave Clinton, giving men a free pass for two decades. Many liberals even resisted the movement to end rape on campus. And yet, legal, political, and cultural efforts, often spearheaded by women of color, were quietly paving the way for the takedown of abusers and harassers. Reckoning delivers the stirring tale of a movement catching fire as pioneering women in the media exposed the Harvey Weinsteins of the world, women flooded the political landscape, and the walls of male privilege finally began to crack. This is revelatory, essential social history.

Book Report on Civil Remedies for Sexual Assault

Download or read book Report on Civil Remedies for Sexual Assault written by British Columbia Law Institute and published by . This book was released on 2015 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report addresses the way in which civil damages are assessed and awarded to the victims of sexual assault. Civil actions for damages, broadly speaking, comprise lawsuits commenced by plaintiffs against defendants for alleged wrongful conduct. Sexual assault can be defined as the intentional application of force that violates a person's sexual integrity, without that person's consent. Civil actions for damages are one means by which survivors may seek redress after they have been sexually assaulted. In particular this report focuses on compensation issues, which requires translating the harm of the wrongful conduct into monetary damages in order to compensate the plaintiff for his or her losses.

Book Vicarious Liability in the Common Law World

Download or read book Vicarious Liability in the Common Law World written by Paula Giliker and published by Bloomsbury Publishing. This book was released on 2022-10-20 with total page 267 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the one place to find unprecedented access to case-law, doctrinal debates and comparative reflections on vicarious liability from across the common law world. The doctrine of vicarious liability, that is strict liability for the torts of others, represents one of the most controversial areas of tort law. Unsurprisingly it is a doctrine that has been discussed in the highest courts of common law jurisdictions. This collection responds to uncertainties as to the operation of vicarious liability in twenty-first century tort law by looking at key common law jurisdictions and asking expert scholars to set out and critically analyse the law, identifying factors influencing change and the extent to which case-law from other common law jurisdictions has been influential. The jurisdictions covered include Canada, England and Wales, Australia, Singapore, Ireland, Hong Kong and New Zealand. In providing critical analysis of this important topic, it will be essential and compelling reading for all scholars of tort law and practitioners working in this field.

Book Civil Wrongs and Justice in Private Law

Download or read book Civil Wrongs and Justice in Private Law written by Paul B. Miller and published by Oxford University Press. This book was released on 2020-02-05 with total page 496 pages. Available in PDF, EPUB and Kindle. Book excerpt: Civil wrongs occupy a significant place in private law. They are particularly prominent in tort law, but equally have a place in contract law, property and intellectual property law, unjust enrichment, fiduciary law, and in equity more broadly. Civil wrongs are also a preoccupation of leading general theories of private law, including corrective justice and civil recourse theories. According to these and other theories, the centrality of civil wrongs to civil liability shows that private law is fundamentally concerned with the expression and enforcement of norms of justice appropriate to interpersonal interaction and association. Others, sounding notes of caution or criticism, argue that a preoccupation with wrongs and remedies has meant neglect of other ways in which private law serves justice, and ways in which private law serves values other than justice. This volume comprises original papers written by a wide variety of legal theorists and philosophers exploring the nature of civil wrongs, their place in private law, and their relationship to other forms of wrongdoing.
