Book The Charter of Rights and Freedoms

Download or read book The Charter of Rights and Freedoms written by Robert J. Sharpe and published by Irwin Law Incorporated. This book was released on 2009 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: Written by two of Canada s leading constitutional scholars, no other Canadian book provides such an accessible yet thorough and objective account of the Canadian Charter of Rights and Freedoms. The authors survey the manner in which Canadian courts have come to terms with a constitutionally entrenched bill of rights, focusing on the decisions of the Supreme Court of Canada. The purpose is to explain the Charter, its interpretation by the courts, and its practical application. The text has been thoroughly updated to reflect Charter jurisprudence since publication of the third edition in 2005. Notable among those developments are significant changes to the way the Supreme Court has approached the interpretation of equality rights, constitutional remedies, and most recently the rights of the criminally accused.

Book The Charter of Rights and Freedoms

Download or read book The Charter of Rights and Freedoms written by Ian Greene and published by James Lorimer & Company. This book was released on 2014-11-18 with total page 442 pages. Available in PDF, EPUB and Kindle. Book excerpt: Canada’s Charter of Rights and Freedoms has transformed Canadian life since it was adopted as part of the Canadian constitution in 1982. The Charter requires judges to make decisions on a wide range of issues that affect all Canadians. In doing so, the courts play a major role in citizens’ lives. Because of the Charter: - The law against prostitution was struck down. - The Harper government"s treatment of child soldier Omar Khadr was found to violate his rights. - Vancouver’s Insite safe injection site was kept open, overriding a federal government decision requiring it to shut down. Ian Greene is a political scientist, and his focus in this book is to highlight the many significant ways the Charter shapes Canadian life. After providing background on the creation and implementation of the Charter, he describes its impact on a wide range of issues — aboriginal affairs, voting rights, freedom of religion, the right to strike, and language rights, among others. Greene describes key decisions in these areas and comments on the often-conflicting views of the judges deciding them. Even though the Charter is a legal document, debated by lawyers and decided by judges, Greene approaches his subject with an eye on the political impact the Charter has on governments and ordinary citizens. Public discussion of the Charter is often framed around the question of who should make these important decisions — elected politicians or unelected judges. This book provides a clear understanding of how the Charter works and how ordinary citizens have succeeded — or failed — to win change from the courts. It offers information that people on every side of public discussion can use regarding the role of the Charter in Canadian life.

Book excerpt: "This new book, published to accompany an exhibition at the National Archives, studies the dramatic events and philosophies which guided the Founding Fathers in the creation of these historic documents, the profound effect they have exercised on subsequent American history, and their wider influence on world politics." "Specially commissioned color photographs of the newly reinstalled Charters complement a selection of original documents, which include some of America's greatest documentary treasures. Additional images include color plates of the restored murals, which adorn the renovated Rotunda, and paintings and engravings of the major figures and events in American history, which enhance the original documents. Quotes from the nation's Founders and other historic figures are also included, together with an accessible narrative text arranged to reflect each of the fourteen sections making up the exhibit. Together these elements reveal the drama, passion, and poignancy of the struggle for freedom that has defined much of U.S. history."--BOOK JACKET.

Book Freedom of Conscience and Religion

Download or read book Freedom of Conscience and Religion written by Richard Moon and published by Essentials of Canadian Law. This book was released on 2014 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the Canadian Charter of Rights and Freedoms was enacted in 1982, the first of its fundamental freedoms seemed less significant and less interesting than many of its other rights. However, the Salman Rushdie affair, the 9/11 attacks, and later the publication of the "Danish Cartoons" helped to move religion or religious difference to the forefront of public consciousness. These events seemed to confirm that religion, or at least particular religions, represented a threat to the values of liberal-democratic society. Religious freedom issues that may have been minor and easily resolved "on the ground" were increasingly seen through this lens of intractable conflict, and as opening the door to a broader threat to Western democracy. In Canada, anxiety about religion has been far less acute than in Europe or in the United States. Nevertheless, concern about the character of religion has shaped the public reaction to religious diversity and freedom. This has been most powerfully so in Quebec where, as in Europe, national identity remains a concern, and the political role of the Catholic church in the recent past has caused many to be wary of the visibility of religion in the public sphere. The book reviews the basic history of religious freedom in Canada; looks at state support for religion, including the place of religious practices and symbols in public institutions and the role of religious values in public decision making; the restriction or accommodation of religious practices by state action; religious restriction in particular contexts; state support for religious schools; freedom of religion in the context of the family, and in particular, the parent-child relationship; and freedom of conscience component of section 2(a)
