Their demands are justified not only on the basis of the promise of Doha Ministerial Declarations and Decisions but also on any calculation of give and take in the multilateral trade negotiations. Developing countries, particularly African and least-developed countries (LDCs), are not free riders in the multilateral trading system. In fact they have offered more concessions than their developed country partners in the Uruguay Round and the WTO. Their concessions are not limited to binding themselves to stringent multilateral rules in new areas such as trade-related intellectual property rights (Agreement on TRIPS), trade-related investment measures (Agreement on TRIMS) and services (General Agreement on Trade in Services). Even in the area of market access their commitments go far beyond those of the developed countries. Hence developing countries should not be on the defensive. They have contributed and continue to contribute to the multilateral trading system, often far beyond their capacities and certainly more than their developed country partners.

Within the WTO evidence of the institutionalization of the norm can be found both in the agreements and legal documents and the way in which the LDCs have been treated by other states. Helen Hawthorne investigates how norms impact on negotiations in international organisations. She shows that few studies of international organisations focus on the role of the weaker states in the organization, the majority focus either on the major states or the emerging economies. By ignoring the role of the poorer, weaker states in the GATT/WTO we are ignoring the history of these states in the organisation and do not get a true picture of the organization, how it operates in relation to them and their impact on the organisation.

Book excerpt: The final paragraph of the ministerial declaration of the 10th World Trade Organization (WTO) Ministerial Conference, held in Nairobi, Kenya, created the possibility of bringing so-called 'new issues' to the WTO. Whilst the declaration does not provide a mandate to negotiate or make any mention or details of the 'other issues', there is an urgent need to objectively examine some of the potential 'new issues', with a view to developing a better understanding among the Commonwealth developing countries of these, particularly with respect to least-developed countries (LDCs), small states and sub-Saharan African countries. The goal of so-doing is to assist them in identifying their own interests and concerns regarding these issues and, hence, enable their better-informed and active participation in various informal discussions. The purpose of this International Trade Working Paper is meeting this need. After briefly discussing some general contextual and background points about the new issues, the paper provides a brief but comprehensive analysis of several new issues. It concludes by offering some reflections and recommendations for the consideration of Commonwealth developing countries, in particular LDCs, small states and sub-Saharan African countries.
