Book excerpt: Incomplete property rights are common across a range of natural resources such as fisheries and groundwater. The High Plains Aquifer region of Kansas provides one example of a complex but incomplete system of property rights. Rights to groundwater in Kansas are incomplete due to the physical characteristics of the resource, limited transferability between irrigators, and regulatory uncertainty. This paper takes a hedonic approach to understanding how three core features of prior appropriation water rights in Kansas--access, allocation, and seniority--confer value to irrigated farmland. All three water right features are priced into land values. Groundwater access rights confer an average land value premium of 71%, or $1,443/acre. Water rights having larger allocations and more seniority are more valued in the land market. The effect of seniority is consistent with more junior rights facing greater regulatory risk of curtailments. Our results indicate incomplete resource rights still confer value. Additionally, we use our empirical estimates to quantify the distributional costs of adopting modified groundwater governance regimes that ignore heterogeneity in allocation or seniority.

This paper combines theory and empirics to produce a causal estimate of the net benefit of using property rights to manage groundwater. We develop a model of dynamic groundwater extraction to demonstrate how a spatial regression discontinuity design exploiting an incomplete property rights setting can recover a lower bound on the value of property rights. We apply this estimator to a major aquifer in water-stressed southern California, finding groundwater property rights led to substantial net benefits, as capitalized in land values. Heterogeneity analyses suggest that gains arise in part from the tradeability of property rights, enabling more efficient water use across sectors.

In general, American states and not the national government control water resources. Western states generally define water rights as property rights and apply the prior appropriation doctrine, or “first in time is first in right”, to handle disputes in times of shortage. Kansas, located in the center of the U.S., adopted this doctrine in its 1945 Water Appropriation Act and expressly defined water rights as “real property rights.” Permits were issues through the 1960s when authorities became aware that groundwater depletion was occurring in the groundwater aquifers. The legislature then enacted a statute that enabled creation of “groundwater management districts” (GMD), which were to allow local control of groundwater within the framework of Kansas water law, and “intensive groundwater use control areas” (IGUCAs), for more intensive management in serious problem areas. An IGUCA was created in the Cheyenne Bottoms area in 1992, and the Order cut back on existing irrigation water rights by limiting annual quantities from 64% to 71%. A potential problem with cutting annual quantity of existing water rights is that such action might amount to a “taking” of property, for which compensation to the water right holder should be paid, but the irrigators did not appeal the Order The article describes other attempts to control groundwater withdrawals, discusses philosophical and policy issues, and proposes a solution for Kansas that would involve incremental reduction of groundwater pumping to achieve safe yield 25 or 40 years in the future.
