ISIS’ dystopian experience, intended as a short-lived territorial and political governance, has been analyzed from multiple points of view, including the geopolitical, social and religious ones. However, its legal dimension has never been properly dealt with in a comprehensive way, assuming as a point of reference both the Islamic and the Western legal tradition. This book analyzes ISIS as the expression of a potential though never fully realized legal order. The book does not describe ISIS’ possible classifications according to the standards and the criteria of international law, such as its possible statehood or proto-statehood, issues that are however touched upon. Rather, it analyzes ISIS’ own legal awareness, based on the group’s literary materials, which show a considerable amount of juridical work. Such material, mainly propagandistic in its nature, is essential in understanding which kind of legal order ISIS aimed at establishing. Book excerpt: Like anywhere else, the present-day Islamic world too is grappling with modernity and postmodernity, secularisation and globalisation. Muslims are raising questions about religious representations and authority. This has given rise to the emergence of alternative Islamic discourses which challenge binary oppositions and dichotomies of orthodoxy and heterodoxy, continuity and change, state and civil society. It also leads to a dispersal of authority, a collapse of existing hierarchical structures and gender roles. This book further argues that the centre of gravity of many of these alternative Islamic discourses is shifting from the Arabic-speaking 'heartland' towards the geographical peripheries of the Muslim world and expatriate Muslims in North America and Europe. At the same time, in view of recent seismic shifts in the political constellation of the Middle East, the trends discussed in this book hold important clues for the possible direction of future developments in that volatile part of the Muslim world.

The book explains a dual process of analysis measuring immediate needs of the individual, relative to long term gains possible through prosocial behavior (e.g. synergy, accumulating profits, (in)direct reciprocity) with the output further mitigated by the motivation of the individual at that moment and any special circumstances of the environment. Ultimately it can be shown that prosocial behavior can be economically rational. Yet even when individuals are intrinsically motivated to act prosocially, they are also able to reverse this behavior when they sense it is no longer adaptive. The author carves out the entanglements of jihadist ideology and warfare with geographical concepts at Africa’s periphery of the Islamic world: geographical knowledge about the boundary between the “Land of Islam” and the “Land of War”; the pre-colonial construction of “the Muslim” and “the unbeliever”; and the transfer of ideas between political elites and mobile actors (traders, pilgrims, slaves, soldiers), whose reports helped shape new definitions of the African frontier of Islam.
