She has been encouraged to believe herself entitled to that position by Prince Haleem, the plaintifi in this suit, by Curreemunessa and by the three heads of the family, by whom the statement of the 13th November 1872 was made to the Government; and by, at least the tacit, acquiescence in her claims by all the other members of the family. We therefore think that her costs as between attorney and client, both in this Court and in the Court below, should be paid out of the estate. The costs ordered in the Court below to be paid by Mahatala and Curreemunessa to other persons will be paid to those persons out of the estate, except the special costs ordered to be paid by Curreemunessa on account of the time unduly occupied by the cross-examination of Mahatala. _ As regards the costs of the appeal, we think that Curreemunessa had no suflicient reason to appeal to this Court; and she must therefore pay her own costs. The costs in this Court of Prince Haleem and of the other parties to this appeal, except Nusseeruddeen and Prince Furruck Shah, will be paid out of the estate on scale 2. There appears to be no provision in the Procedure Code for such an applieation_ The petitioner's pleader first of all referred to section 108 of the Code, as being the section under which his client has come to Court. It is clear that that section has no application and the pleader, perhaps seeing the mistake, referred the Court to section 623 of the Code. I do not see how that section can apply to such a petition as the present. Besides section 623 evidently applies to cases, in which the applicant for review had appeared before and considers himself aggrieved by the decision passed in his presence. In the present case, the petitioner does not seem to enter appearance in the execution case instituted against him. In short, I am of opinion, that the present appli-cation does not come either under section 108 or section 623 of the Code of Civil Procedure and should be disallowed. I order that the petition be rejected with costs." The judgment-debtors then preferred this appeal. Baboo Mohesh Chuncler Chowdhry and Baboo S1-ish Ohander Chowdhry, for the Appellants. The judgment of the High Court (1) was as follows: It appears to us that the Subordinate Judge was right in holding that section 108 does not apply, not upon the ground assigned by him, but upon the ground that in the petition, the petitioner did not state that they were prevented by any suflicient cause from appearing when the suit was heard. But we cannot concur with the Subordinate Judge in his opinion that section 623 does not apply to this case.
