Book excerpt: For many businesses, bankruptcy is a looming reality, one that can take many forms. Bankruptcy is such a fact of life that a tangle of laws exist in the U.S. legal code. The most widely recognised type, Chapter 11, permits the reorganisation, as opposed to the liquidation, of financially troubled businesses. An economic analysis has to start with the observation that business failure is not always bad, as efficiency in the economy demands continual reallocation of resources. This book offers a thorough overview of the bankruptcy laws and procedures American businesses and consumers are faced with.

Book The Bankruptcy Reform Act Vol 1

Download or read book The Bankruptcy Reform Act Vol 1 written by United States Committee on th Judiciary and published by Forgotten Books. This book was released on 2016-12-27 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Bankruptcy Reform Act, Vol. 1: Hearings Before the Subcommittee on Improvements in Judicial Machinery of the Committee on the Judiciary, United States Senate, Ninety-Fourth Congress, First Session on S. 235 and S. 236; February 19, 20; March 12, 13; April 16, 17, 24, 1975 The jurisdiction of the bankruptcy courts would extend to all disputed matters arising in the course of a bankruptcy or reorganization case. The dichotomy be tween summary and plenary jurisdiction, which has been productive of endless and pointless litigation, would disappear. All actions to which a trustee is a party will lie in the bankruptcy court. Possession of the property of the estate by some one other than the bankrupt - even custody by some other court - will not be a limitation on the bankruptcy court's jurisdiction. This allocation of judicial responsibility should permit expeditious disposition of litigation arising out of bankruptcy and reorganization cases and should terminate the game playing that goes on now in connection with the choice of forums for various categories of controversies and proceedings under the Bankruptcy Act. Available in PDF, EPUB and Kindle. Book excerpt: Corporate bankruptcy is a defining characteristic of the market economy. It encapsulates the fundamental conflicts between capital and labour, owners and managers, debtors and creditors, the state and the market. Yet, with one or two notable exceptions, the political and social dynamics ofbankruptcy law and practice have been overlooked by serious socio-legal scholars. This book remedies that neglect. Adopting an approach that compares English and American law, the authors identify the underlying political forces that established corporate bankruptcy law on both sides of the Atlantic. The book demonstrates how, by a recursive loop of professional self-interest,corporate insovency regulation is the creation of the lawyers who interpret and administer it. This book will be welcomed as an important sociological study and advances our understanding of how substantive law results from conflicts among the professionals who help to create it.
