Book excerpt: Excerpt from The Boston Medical and Surgical Journal, Vol. 56: February, 1857 to August, 1867 This was an action brought against a physician and surgeon of Worcester, Mass., to recover damages for alleged malpractice in the treatment of a fracture of the bones of the fore-arm. The trial, which took place in Boston, before his Honor Judge Measles, commenced in the forenoon of January 13th, extended through that day and the next, and on the following morning was brought to a sudden conclusion, in a manner so striking and unusual in itself, as well as triumphant to the defendant, that the case has been invested with a peculiar interest, both to the profession and to the community. This was the first trial of the kind in this Commonwealth, since the enactment of the law of June, 1856, providing that parties may be witnesses. The clear and convincing statement of the defendant, as well as his admirable bearing on the stand, during a thorough examination and cross-examination of more than two hours, contributed in great part to the favorable and decisive result of the action. The material evidence in the case, as taken from the notes of the defendant's counsel, was in substance as follows. The relief was instantaneous - the patient breathed freely and without any cough, and fell into a calm sleep. Within three hours the uterus resumed its action, and a dead child was expelled. The uterus contracted firmly, and there was no hemorrhage. Until midnight everything promised well. Then her pulse, which had been reduced by the operation from 150 to 120, 'began to grow weaker and more rapid; the respiration continued free, but grew. More frequent. Stimulation was in vain. M. Hodges, dur ing a period of ten years, is reported for the purpose of showing the ultimate and excellent results of excision of the elbow when recovery takes place, and the advantages of a single straight incision in its performance. This method, largely avoiding the cross-cutting of any tissues, allows the connection of the triceps-extensor tendon, with the investing aponeurosis of the arm and fore-arm, to be preserved almost intact. An attachment for the muscle is thus retained which diminishes, to a certain extent, the loss of power following its unavoid able separation from the olecranon. 1 Transverse incision of the integ uments, even though the above mentioned connection is maintained, is in itself prejudicial to the subsequent motions of the limb, if the ound does not unite by first intention, but cicatrizes by granulation, as it almost invariably does.
